China Fines 2 Notifiers for Failing to Upload Cosmetic Efficacy Evaluation Summary

Two general cosmetic enterprises were warned and fined 10,000 yuan respectively for failing to upload the cosmetic efficacy evaluation summary. The supervision and inspection of enterprises\’ implementation status of the new regulation have begun. Background In Cosmetic Supervision and Administration Regulation (CSAR), National Medical Products   Administration (NMPA) specifies that cosmetic\’s efficacy claims shall be supported by sufficient scientific basis, and requires enterprises to publicize the summary of cosmetic efficacy evaluation. Later on Apr. 9, 2021, NMPA issued the finalized Standards for Cosmetic Efficacy Claim Evaluation, rolling out a detailed plan to standardize and guide the evaluation of cosmetic efficacy claims. China NIFDC Consults on Three Test Methods for 72 Cosmetic Ingredients, Fragrance Components and Prohibited Colorants Included

On July 8, 2022, China National Institutes for Food and Drug Control (NIFDC) launched public consultation on three draft testing methods for 72 cosmetic ingredients, including 40 fragrance components, 24 prohibited colorants, and 8 hair perming agents. Cosmetic stakeholders can send suggestions to hzpbwh@nifdc.org.cn before July 31, 2022. 1. Determination of Ethyl Acrylate and Other 39 Kinds of Components in Cosmetics Regarding the determination of fragrance components, China has set national standards such as \”GB/T 24800.9-2009 Determination of Citral, Cinnamyl Alcohol, Anise Alcohol, Cinammal and Courmarin in Cosmetics by Gas Chromatography Method\” and \”GB/T 24800.10-2009 Determination of 19 Flavors in Cosmetics by Gas Chromatography-mass Spectrometry Method\”. However, it is found that these standards cannot fully meet the testing demand in practice, therefore this new method is developed. China NMPA Implements the Finalized Good Manufacturing Practices for Cosmetics On July 1, 2022, China implemented the finalized Good Manufacturing Practices for Cosmetics. The Practices stipulates the qualification requirements and duties of the person in charge of quality and safety, ensures the traceability of the product from production to market, refines the requirements for sample retention, further clarifies the requirements for entrusted production, etc.Starting from July 1, 2022, cosmetics registrants, notifiers, and entrusted production enterprises (including cosmetic enterprises that only engage in the preparation of semi-finished products, and toothpaste enterprises) shall organize the cosmetic production in accordance with the Practices. China NMPA Implements the Finalized Good Manufacturing Practices for Cosmetics

In September 2020 and 2021, China National Medical Products Administration (NMPA) released the first and the second draft of Good Manufacturing Practices for Cosmetics (hereinafter referred to as “Practices”). After two rounds of public consultation, on January 7, 2022, NMPA released the finalized Practices and implemented it on July 1, 2022. 1 Starting from July 1, 2022, cosmetics registrants, notifiers, and entrusted production enterprises (including cosmetic enterprises that only engage in the preparation of semi-finished products, and toothpaste enterprises) shall organize the cosmetic production in accordance with the Practices; For enterprises that have obtained production licenses before July 1, 2022, if their facilities, equipment, etc., shall be upgraded according to the Practices, the upgrading and reconstruction shall be completed before July 1, 2023. China Modifies Declaration Requirements for Imported Cosmetics

On June 20, 2022, the General Administration of Customs, P.R. China (GACC) released an announcement modifying the declaration requirements for some imported cosmetics. When the consignee of imported cosmetics and their agents declare cosmetics whose HS code starts with 3303 and 3304, they should fill the product quantity in the customs declaration form according to the following requirements. China NIFDC Takes Measures on Cosmetics Regulatory Compliance Due to COVID-19

As the COVID-19 resurges repeatedly, cosmetics registrants and notifiers are confronted with practical difficulties when fulfilling the requirements for registration and notification. To help cosmetic enterprises withstand the impact of the COVID-19, China National Institutes for Food and Drug Control (NIFDC) introduced temporary measures for cosmetics registration and notification on June 2, 2022.   Incompleteness-tolerant Policy Is Adopted for Cosmetics Registration and Notification For some cosmetics registrants and notifiers who are unable to provide complete dossiers, the acceptance departments can implement a temporary incompleteness-tolerant policy. Under this policy, the registrant and notifier are allowed to submit the electronic copies or photocopies first, and supplement the original copy of relevant dossiers after the lockdown ends.
