China New Cosmetic Ingredient Notification: The Current Situation

Starting from May 1, 2021, China has implemented a notification system for general cosmetics and low-risk new cosmetic ingredients. Under the new system, as long as companies completed the submission of dossiers online, their new cosmetic ingredients are considered as “notified” and then can be manufactured or imported. There is no longer a pre-market review on notification dossiers, instead, the basic notification information will be made public within five working days after the submission. China NIFDC Consults on Limitation of Benzene in Cosmetics

To strengthen the management of safety risk substances in cosmetics, on Mar. 10, 2022, China National Institutes for Food and Drug Control (NIFDC) released an announcement seeking public comments on benzene (CAS No. 71-43-2) limitation requirements. According to the risk assessment results, the limit of benzene in cosmetics is proposed to be 2mg/kg. 1 Stakeholders can send suggestions to hzpbwh@nifdc.org.cn before Mar. 31, 2022. Benzene is classified as a human carcinogen. Exposure to benzene can occur by inhalation, orally, and through the skin, and it can result in cancers including leukemia and blood cancer of the bone marrow and blood disorders which can be life-threatening. 2 Trace amounts of benzene introduced into cosmetics can pose a potential hazard to human health. In China, benzene is included in the List of Prohibited Ingredients Used in Cosmetics, and shall not be employed in producing cosmetic products. On March 10, 2022, China NMPA issued an announcement, answering frequently asked questions about cosmetic ingredient safety information, efficacy claim evaluation and sample retention. Brands Authorize Factories to Register/Notify Cosmetics in China, Is It Compliant?

China Cosmetic Supervision and Administration Regulation was officially implemented on January 1, 2021. A series of subsidiary regulations have been released continuously, making more scientific and rigorous adjustments to all aspects of the cosmetic industry. The new regulations introduced the concept of “registrant/notifier\”, the entity that obtains the registration / notification certificate. The registrant/notifier shall set up a person in charge of quality and safety, establish a production quality management system, put the product on the market, and be responsible for the product\’s quality, safety, and efficacy claims. However, the shortage of person in charge of quality and safety in China has plagued brands that entrust factories to produce cosmetics. In response to this problem, some brands choose to transfer the registration / notification right to factories that have been equipped with person in charge of quality and safety. CSAR Subsidiary Regulations: China to Implement Supervision and Administration Measures on Cosmetics Manufacture and Operation

On Aug. 2, 2021, China State Administration for Market Regulation released the finalized Supervision and Administration Measures on Cosmetics Manufacture and Operation (hereafter referred to as “Measures”), which will come into force on Jan. 1, 2022.  The Measures consists of 7 chapters with 66 provisions, detailing cosmetic manufacture and operation management. Highlights include: Optimizing production license management system; Refining and clarifying the production management requirements; Refining and clarifying the operation management requirements; Strengthening the supervisory responsibilities of the administration department. China Introduces Transitional Arrangements Concerning the Change of Cosmetics Registration and Notification Information Management Platforms

The transitional arrangements mainly clarify matters related to the acceptance, review, and approval of cosmetic registration and notification during the transitional period between the previous and the new cosmetics registration and notification information management platforms. To ensure smooth and orderly progress of cosmetics registration and notification work during the transition period between the old and new cosmetic regulations, China National Medical Products Administration (NMPA) released a set of transitional arrangements on May 7, 2021. 1 Specifics are as follows: The new cosmetics registration and notification information management platform (“new platform”) officially put into service on May 1, 2021. Breaking News! China to Exempt Animal Testing for Imported General Cosmetics on May 1

Background Last August and November, China released the first and second draft Instructions for Cosmetic Registration and Notification Dossiers which proposed that general cosmetics could be exempted from animal testing. General cosmetics refer to all the products complying with the definition of cosmetics within the Cosmetic Supervision and Administration Regulation (CSAR), except for the special cosmetics namely hair dyes, hair perming products, freckle-removing and whitening products, sunscreens, anti-hair loss products and cosmetics claiming new efficacy. On Mar. 4, 2021, China NMPA finally released the finalized Instructions for Cosmetic Registration and Notification Dossiers (renamed as Provisions for Management of Cosmetic Registration and Notification Dossiers). Proya: A Company Perspective on Ingredient Management under China’s New Cosmetic Regulations

Breaking News: China Finalises the Long-Awaited Cosmetic Supervision and Administration Regulation

On June 29, the new fundamental cosmetic legislation-Cosmetic Supervision and Administration Regulation (CSAR), was officially published by the Chinese State Council to replace the existing Cosmetics Hygiene Supervision Regulations (CHSR), which was firstly released in 1989. The new regulation is scheduled to be effective on January 1, 2021. Encompassing 6 chapters with 80 articles, the new CSAR is designed to overhaul the outdated regulatory framework and address issues revolving around cosmetic pre-market and post-market management in new situations, such as cosmetic classification, new ingredient management, efficacy evaluation, safety assessment, online cosmetic supervision, accountability system, and punitive measures.
