China Cosmetics Regulations Changes

China Cosmetics Regulations Changes July 20th 2015 marked the day that the China Food and Drugs Administration released the second version of the Draft regarding Cosmetic Regulations, this will replace November 15th 2014 version. The draft is the evolved version of the Umbrella law on cosmetic Supervision and Administration Regulation which was created in 1989. We are now in the period that is called “the public consultation” and this period ends August 20th, this is a critical period because it might be the last chance to interact with the CFDA before the Draft becomes official. What is the draft? The draft is the revised version of the Cosmetic Health Supervision Regulations. To brush or not to brush

Last month China turned every eye in the cosmetic industry on itself after they released the revision of the Draft. Why was it necessary to revise the Draft? To understand this we must first understand the definition of “cosmetics” in China. According the China Food and Drugs Administration cosmetics refers to products that are applied to the human body surfaces (lips, skin, nails, hairs, etc.) teeth and oral mucosa by smearing, spraying or using any other similar approach with the purpose of cleaning, protecting, modifying and safe keeping its condition. The main functions of oral care products such as toothpaste are cleaning and beautification, only these two functions should be enough to add toothpaste into the cosmetics category. SFDA consults on a newly-added licensing procedure for special use cosmetics

On August 20, 2012, SFDA started to seek public comments on a notice concerning a newly-added licensing procedure to further regulate the format and content of submitted application dossiers.

SFDA Simplifies Modification Application of Cosmetic Administrative Licensing

SFDA consults on a draft notice of further simplifying modification of companies’ names or addresses on the condition that the production site does not been changed.

According to the notice, cosmetic manufacturers that already obtain the hygiene license or record keeping certificate from SFDA, are allowed to apply for one-time modification of names, addresses, responsible agents in China together with product information that is under processing. Documents that have been submitted before need not submitting repeatedly.
