Vietnam Drafts Technical Regulation to Restrict Persistent Organic Pollutants in Products

The proposed technical regulation specified the concentration limit of POPs in articles, products, goods and equipment. On September 15, 2022, Vietnam released the second draft of the National Technical Regulation on thresholds for Persistent Organic Pollutants in Articles, Products, Commodities and Equipment on WTO’s platform for notification and started to seek public comments. The comment date is due on November 14, 2022.The regulation applies to organizations and individuals engaged in import, manufacture, trading, and use of articles, products, commodities and equipment containing POPs. Vietnam to Revise Chemical Regulations: Law on Chemicals (06/2007/QH12)

The revision is proposed to improve the practicality and feasibility of the law and enhance the efficiency and effectiveness of national chemical management. On October 12, 2022, Vietnam’s Ministry of Industry and Trade (MOIT) released a proposal to revise the Law on Chemicals (06/2007/QH12)*. The draft revision is expected to be finalized and submitted for comments at the 8th Session of the 15th National Assembly in October 2024 and approved at the 9th session in May 2025. *The Law on Chemicals (06/2007/QH12) is the overarching chemical regulation in Vietnam, which was issued in November of 2007 and took effect in 2008. It stipulates provisions on the management of production, trading, import and export, use and disposal of chemicals, safety in chemical handling, chemical information transfer, etc. The proposal came as the Law on Chemicals gradually lost its harmony and consistency in the entire regulation system after 14 years of implementation….

How to Prove Your Polymers are Eligible for Record Notification under MEE Order No.12?

Almost two years have passed since the Measures of Environmental Management Registration of New Chemical Substances (MEE Order No.12) took effect on January 1, 2021. As polymers are generally regarded as representing a low safety concern, they can benefit from exemption or reduced registration requirements under some circumstances. According to MEE Order No.12 (i.e. China REACH), polymers that meet certain criteria* can apply for record notification regardless of annual volumes. This provision has attracted widespread attention from the chemical industry. * If a polymer meets any of the following criteria, it shall be subject to record notification (rather than simplified or regular registration), regardless of annual volumes. Polymer containing less than 2% monomers or reactants which are new chemical substances (a.k.a. \”2% Rule\”); or Polymer of low concern (PLC). Australia Revokes the CBI Approvals for 2 Chemicals in the AIIC: 1226781-96-9 and 219607-67-7

On September 27, 2022, the Australian Government published a notice to revoke the CBI approvals for the proper names of 2 industrial chemicals in the Australian Inventory of Industrial Chemicals (AIIC). These 2 industrial chemicals are: CAS number Chemical name 1226781-96-9 2-Propenoic acid, 2-methyl-, butyl ester, polymers with N-[3-(dimethylamino)propyl]-2-methyl-2-propenamide, 2-hydroxymethylethyl-terminated hydrogenated polybutadiene methacrylate, lauryl methacrylate, Me methacrylate, myristyl methacrylate and styrene 219607-67-7 2-Propenoic acid, butyl ester, polymer with (chloromethyl)oxirane, ethenylbenzene and 4,4′-(1-methylethylidene)bis[phenol] Chemicals that are listed in the AIIC can be introduced by any registered introducers (importers or manufacturers). According to the IC Act 2019, introducers shall apply for registration before introducing an industrial chemical to Australia during a registration year (goes from September 1 to August 31). China\’s Taiwan Region to Prohibit Import of Products Containing Asbestos

On October 4, 2022, the EPA of China\’s Taiwan region issued a notice to prohibit the import of products containing asbestos from May 1, 2023. Violations will be fined between NT$ 60,000 and NT$ 300,000. EPA designated asbestos as a Class 2 toxic chemical substance under the Toxic and Concerned Chemical Substances Control Act (a.k.a. TCCSCA) on May 1, 1989, and phased in restrictions on the use of asbestos in the following years. From January 1, 2018, all uses of asbestos have been prohibited in Taiwan, China, except for R&D, testing and education applications. The import prohibition will cover all types of asbestos-containing products. There are six recognized types of asbestos, including: Crocidolite; Amosite; Anthophyllite; Actinolite; Tremolite; and Chrysotile. What is Asbestos?
