January 2023: Chemical Regulatory Updates in Europe and America

This is a collection of regulatory updates in Europe and North America, including EU REACH, UK REACH, and US TSCA. European Union & United Kingdom The European Chemical Agency (ECHA) added nine hazardous substances to the Candidate List of SVHCs on January 17, 2023. They are used for example in flame retardants, paints and coatings, inks and toners, coating products, plasticizers and in the manufacture of pulp and paper. Now the list contains 233 chemicals that can harm people or the environment. FAQs for China REACH: how to comply with environmental management registration requirements?

The SCC-MEE released the fifth batch of 9 FAQs to help enterprises fulfill their obligations under the MEE Order No.12. With the MEE Order No.12 in effect, the Solid Waste and Chemical Management Center of the Ministry of Ecology and Environment (SCC-MEE) has released a series of FAQs to help enterprises fulfill their obligations under the MEE Order No.12. Vietnam Updates Rules on Chemical Licensing, Reporting, Labelling, and Transport

A new license shall stay valid for 5 years for restricted chemical producers and traders. On October 27, 2022, Vietnam\’s Ministry of Industry and Trade promulgated Circular No.17/2022/TT-BCT to amend and supplement several articles of Circular No.32/2017/TT-BCT, a circular that provides guidelines for implementation regulations of Law on Chemicals. The Circular takes effect from December 22, 2022. Earlier on October 17, Vietnam passed Decree No.82/2022/ND-CP to revise the existing Decree No.113/2017/ND-CP, which introduced changes in the List of Restricted Chemicals (Annex II). Companies are required to obtain a license before producing or trading chemicals in Annex II. Vietnam Revises Rules on Implementation of Law on Chemicals

The revised Decree will clarify hazard classification and introduce 10 chemicals, 6 industrial precursors and 6 POPs for different obligations. On October 18, 2022, Vietnam\’s Government issued Decree 82/2022/ND-CP to introduce amendments to the existing Decree 113/2017/ND-CP, one of many decrees supporting the implementation of the Law on Chemicals. The new Decree is set to take effect on December 22, 2022. According to Article 23 of Decree 113/2017/ND-CP, chemicals shall be classified according to rules and technical guidance of UN GHS from Rev.2 (2007) onwards. However, the building blocks provided in this Article are inconsistent with GHS Rev.2. To address the industry\’s confusion, Article 23 is amended to provide a table of building blocks in line with GHS Rev.2 as the basis and to clearly indicate that the building blocks from UN GHS Rev.2 onwards can be adopted for chemical classification. China Issues First List of New Pollutants for Priority Management (2023)

China\’s first official list of new pollutants for priority management was released, which will come into force on March 1, 2023. On December 30, 2022, the Chinese Ministry of Ecology and Environment made public the List of New Pollutants for Priority Management (2023), which will come into force on March 1, 2023. This is the first official list of new pollutants for priority management. Compared with the 2022 Draft, there is no significant change in the official version. The List of New Pollutants for Priority Management (2023) contains 14 types of new pollutants, specifying their names, CAS numbers and major environmental risk control measures. K-REACH: South Korea Updates Hazard Assessment Results of Registered Chemicals

On December 21, 2022, South Korea’s National Institute of Environmental Research (NIER) issued the NIER Announcement No.2022-87 to make public the updates of hazard results of new and existing chemical substances that were previously registered under K-REACH. Most of the proposed updates published in late November were adopted, however, there are some differences and new updates (marked in red). China REACH: China MEE Adds 42 Substances into IECSC

On December 5, 2022, China’s Ministry of Ecology and Environment (MEE) issued two announcements to make public 42 substances included in the Inventory of Existing Chemical Substances in China (IECSC). See the table below. Announcement MEE Announcement No. 2022-32 MEE Announcement No. 2022-33 Content 36 substances, previously registered under the Measures on Environmental Management of New Chemical Substances (MEP Order No. 7 of 2010), are now qualified for listing in the IECSC as existing chemical substances in China. The addition of 6 substances to IECSC proposed in late August (news) was adopted. These 6 substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window.
