Japan ISHL: Japan to Subject 1,469 Substances for Mandatory SDS and Labeling Requirements

Two batches of 1,469 hazardous substances are proposed to mandate SDS and labelling requirements under Japan ISHL. The Japanese Ministry of Health, Labor and Welfare (MHLW) will listen to overseas stakeholders\’ opinions from March 14, 2023, on the second and third batches of candidate substances subject to mandatory SDS and labeling requirements under the Industrial Safety and Health Act (ISHL).The two batches of candidate substances include: Second batch: 651 substances identified in category 1 of hazard classes other than carcinogenicity, germ cell mutagenicity, reproductive toxicity (CMR) and acute toxicity, to be implemented from April 1st, 2025, and Third batch: 818 substances with health hazards in category 2 and below, or chemicals without health hazards but with physical-chemical hazards, to be implemented from April 1st, 2026. China to Update List of Dangerous Goods

59 items (i.e., UN0510 ~ UN0513, UN3496 ~ UN3550) are proposed to be added to the List of dangerous goods. China’s National Public Service Platform for Standards Information issued a notice on March 1, 2023, seeking public comments on draft revisions to two national mandatory standards, including: GB 6944 Classification and code of dangerous goods GB 12268 List of dangerous goods These two standards were first released in 2005 and revised in 2012. They help standardize the system for dangerous goods transportation, storage, distribution, and other related activities in China. To align with the UN Recommendations on the Transport of Dangerous Goods – Model Regulations (Rev. 22), the UN Manual of Tests and Criteria (Rev. 7), and other relevant regulations and technical standards in China, the authority drafted the revisions to solicit public feedback. China Ratifies Amendments to Stockholm Convention on Persistent Organic Pollutants, Effective June 6, 2023

On December 30, 2022, the 13th National People\’s Congress (NPC) Standing Committee of China announced the ratification of Amendments* to Annexes A and C of the Stockholm Convention on Persistent Organic Pollutants (POPs). As a party to this international treaty, China deposited the instrument of ratification to the Secretary-General of the United Nations on March 8, 2023. *Five POPs have been added to the annexes of the Stockholm Convention. These five POPs include:  Hexachlorobutadiene (HCBD) Pentachlorophenol (PCP) and its salts and esters Polychlorinated naphthalenes (PCNs) Decabromobiphenyl ether (DecaBDE) Short-chained chlorinated paraffins (SCCPs) According to Article 22 (4) in the Stockholm Convention, the abovementioned Amendments shall enter into force for China on the ninetieth day after the date of the deposit with the depositary of the instrument of ratification, i.e., to be effective on June 6, 2023. Shanghai to Regulate Microplastics and BPA as Key New Pollutants from March

From March 2023, strict control measures will be carried out in Shanghai to manage microplastics and BPA, especially for their uses in food contact materials. On February 3, 2023, the Shanghai Municipal Bureau of Ecology and Environment released a notice to make public Shanghai’s list of new pollutants subject to priority management (hereinafter referred to as the Shanghai List), which was formulated based on the national list – List of New Pollutants for Priority Management (2023) and Shanghai\’s Workplan for New Pollutants Treatment. It will come into force on March 1, 2023. China REACH: Deadline for 2022 Annual Reporting on New Chemicals in China – 30 April

A fine will apply if the annual report is not submitted as required. China’s Solid Waste and Chemicals Management Center (SCC) under the Ministry of Ecology and Environment (MEE) issued a notice in late 2022, notifying stakeholders to submit the 2022 annual report via the online registration system before April 30, 2023. The SCC-MEE also provided a list of certificate holders (or their appointed agents) who are obliged to submit the 2022 annual report. Details of the list can be accessed here, including 339 certificate codes, the target certificate holder\’s or their appointed agent\’s name, and the province where the company is located. BREAKING NEWS: ECHA Seeks Opinions on PFAS Restrictions

The European Chemicals Agency invites interested parties to send in scientific and technical information on the manufacture, placing on the market, and use of per- and polyfluoroalkyl substances (PFAS) by 25 September 2023. In a move to phase out per- and polyfluoroalkyl substances (PFAS) smoothly in the EU, the European Chemicals Agency (ECHA) announced a six-month consultation on the PFAS restriction proposal on 22 March 2023, which was submitted by the Danish, German, Dutch, Norwegian, and Swedish authorities. Interested parties are encouraged to submit scientific and technical information on PFAS before 25 September 2023. ECHA\’s scientific committees for Risk Assessment (RAC) and for Socio-Economic Analysis (SEAC) will use this information to evaluate the proposed restriction and form an opinion on it. Taiwan Region Lists 15 Substances as Chemicals of Concern

The listing of 15 substances as chemicals of concern will trigger further regulatory actions under Taiwan TCCSCA. On January 12, 2023, Taiwan EPA listed these 15 chemical substances as concerned chemical substances. Their production, import, sale, use, and storage are now subject to tightened regulations under Taiwan TCCSCA. Online sales of these substances are prohibited immediately. However, transitional periods have been granted for complying with new requirements, including pre-approval prior to manufacturing, import, sales, use or storage, handling quantity recording and reporting, accident prevention and emergency response, labeling, and SDS requirements, etc. For example, existing handlers shall obtain the approval before February 1, 2024. China REACH: Four Chemicals to Be Added into IECSC

On February 13, 2023, the Chinese Ministry of Ecology and Environment (MEE) published a notice to solicit comments on the addition of 4 substances to the Inventory of Existing Chemical Substances in China (IECSC). Comments are welcome before February 24, 2023. Details of these substances can be accessed here, including chemical name (both in Chinese and English), CAS number or Series number, molecular formula, structural formula, etc. These 4 substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window. They are expected to be regulated as existing chemical substances in China, and thus free from new chemical registration or notification requirements under the MEE Order No. 12. February 2023: Chemical Regulatory Updates in Europe and America

This is a collection of regulatory updates in Europe and North America, including EU REACH, UK REACH, and US TSCA. European Union & United Kingdom On February 7, 2023, ECHA announced that the details of the proposed restrictions on around 10,000 PFASs could be accessed on ECHA\’s website. ECHA\’s scientific committees for Risk Assessment (RAC) and for Socio-Economic Analysis (SEAC) will check that the proposal meets the legal requirements of REACH in their meetings in March 2023.
