Update! China MEE Adds 22 Chemical Substances into IECSC

On July 19, 2022, the Chinese Ministry of Ecology and Environment (MEE) published a notice, announcing that 22 substances were included in the Inventory of Existing Chemical Substances (IECSC), which were under consultation from April 28 to May 13, 2022. These 22 chemical substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window. 5 FAQs on CBI Non-disclosure Application under Korea OSHA

10 FAQs are selected to address some problems in submitting MSDS in South Korea, and 5 FAQs on the application for CBI protection. New FAQs will be updated on this website. Please stay tuned. According to the revised Occupational Safety and Health Act, MSDS submission and CBI non-disclosure approval in South Korea through the IT system is mandatory before manufacturing or import of chemicals since January 16, 2021. The detailed requirements are stipulated in the revised Standards for Classification and Labeling of Chemical Substances and Material Safety Data Sheet (MOEL Public Notice 2020-130). However, during the implementation in practice, a lot of problems were encountered. South Korea’s Ministry of Employment and Labor thus initiated a nationwide campaign on MSDS self-check on April 8, 2022 (news). A self-checklist was distributed to Korean manufacturers and importers to fulfill the MSDS self-inspection. Japan Publishes SDS Guidance for New ISHL Requirements

For multi-constituent substances, illustrative examples of how Section 3 and Section 15 could look are given in the guidance. The Japan Chemical Industry Association (JCIA) recently published a guidance to assist the industry in compilating SDSs according to the new requirements under the revised ISHL (news). Compliance Alert: China’s Draft Law on Safety of Hazardous Chemicals Moves to Next Step

The Law is ready for the first reading at the NPC Standing Committee. On July 14, 2022, China State Council issued a notice to elaborate its legislative work plan for 2022, which urges various departments to arrange legislative work in a scientific and rational manner. 2022 Legislative Work Mainly Includes: 16 draft laws are proposed to be deliberated by the National People’s Congress (NPC) Standing Committee, concerning customs duties, value-added tax, mineral resources, etc. Moreover, there are 26 draft laws ready to be submitted for such deliberation, e.g., the Law on Safety of Hazardous Chemicals. 16 administrative regulations are proposed to be formulated or revised, concerning carbon emission trading, urban-mass transportation, safety and protection of radioisotope and radiation devices, etc. The notice stressed that organization and leadership must be enhanced to ensure high-quality and efficient implementation of the legislative work plan. Japan to Ban 56 PFOA-related Compounds Under CSCL

56 PFOA-related compounds will be added into the List of Class I Specified Chemical Substances. 8 kinds of products containing the 56 compounds will be prohibited from import. On July 7, 2022, the Central Environment Council under Japanese Ministry of Economy issued a notice that 56 perfluorooctanoic acid (PFOA)-related compounds will be designated as Class I Specified Chemical Substances controlled under Chemical Substance Control Law (CSCL) after the public consultation in March 2022 and 4 rounds of discussions within the Council afterwards. The List of Class I Specified Chemical Substances will be updated by the amendment of CSCL Enforcement Ordinance to add the 56 compounds. Public consultations (including domestic consultation and TBT notification) will be conducted later this year, and the amendment will be officially released in 2023. UK Consults on Extending the UK REACH Submission Deadlines

On July 5, 2022, the UK’s Department for Environment Food & Rural Affairs (DEFRA) issued a public consultation to extend the current UK REACH submission deadlines. The deadline for comments is September 1, 2022. UK REACH Submission Deadlines The UK REACH Regulation contains transitional provisions to reduce the disruption to industry as they moved to the new regime from EU REACH. These provisions allow companies to submit initial ‘notification’ data in order to continue trading and then subsequently provide the full registration data. The current deadlines for completing this transitional registration process depend on the tonnage and hazard profile of the substance, and the first of the current registration submission deadlines is October 2023. Dangerous Goods Required to Be Declared within 24 Hours Before Arrival at Shanghai Port

The new requirements have come into force from July 1, 2022. On June 24, 2022, the Shanghai International Port Group (SIPG) issued the Notification on Further Strengthening the Safety Management for Hazardous Chemicals Containers (hereinafter referred to as the Notification). The Notification stipulates that from July 1, 2022 the shipping companies and agents involving certain hazardous chemicals shall declare their dangerous goods via email within 24 hours prior to arriving at Shanghai Port. Applicable Scope of Hazardous Chemicals The Notification applies to hazardous chemicals which are listed in the China Inventory of Hazardous Chemicals (2015) (hereinafter referred to as the Inventory) but are not restricted by the International Maritime Dangerous Goods (IMDG) Code.
