🇨🇳Chinese Mainland China MEE Adds 22 Chemical Substances into IECSC On July 19, 2022, the Chinese Ministry of Ecology and Environment (MEE) published a notice, announcing that 22 substances were included into the Inventory of Existing Chemical Substances (IECSC). These 22 substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window. Japan Updates CAS Numbers for Class I and II substances Under PRTR

On July 26, 2022, the Japanese National Institute of Technology and Evaluation (NITE) updated the List of CAS numbers for the Class I and Class II substances controlled under the Pollutant Release and Transfer Register (PRTR) Law. The amendments are for the CAS numbers of substances with Administrative No. 88, 132, 257, 652 and 666. The whole list is accessible here: Japan PRTR SDS ALL LIST. Under the PRTR framework, businesses handling Class I substances are required to estimate and report the release and transfer of such substances regularly. Both Class I and II substances are subject to SDS and labelling requirements under the GHS framework. The number of Class I substances was increased from 462 to 515, and the number of Class II substances is increased from 100 to 134 in October 2021 by revising the Enforcement Order of the Pollutant Release and Transfer Register (PRTR) Law. Air Pollutants Regulation in Taiwan: EPA to Tighten Emission Limits for Hazardous Air Pollutants

On July 29, 2022, Taiwan region’s Environmental Protection Administration (EPA) opened a 60-day public consultation on amendments to the Hazardous Air Pollutant Species and Emission Limit Standards for the First Batch of Stationary Pollution Sources. The draft amendments were proposed based on the Stationary Pollution Source Hazardous Air Pollutant Emission Standards which was promulgated on February 26, 2021 setting emission standards for a total of 22 types of hazardous air pollutants. The proposed amendments include: Renaming as the “Hazardous Air Pollutant Species and Emission Limit Standards for Stationary Pollution Sources” Adding pipe emission limits for 18 hazardous air pollutants; Tightening pipe emission limit for Trichloroethene from 5,000 ppm to 55 ppm; Adding emission limits for 23 hazardous air pollutants discharged by exhaust gas outlets, e.g., factory ventilation holes, rather than by the flue, chimney or pipes. EU REACH: Tonnage Band Changes Will Be Considered by ECHA in Dossier Evaluation Process

Companies that downgrade the tonnage band in their registrations after ECHA has communicated the draft decision to them will need to prove the volume of their substance.   On July 27, 2022, European Chemical Agency (ECHA) published a notice that under EU REACH, the Agency may now take changes to registrants’ tonnage band information into account until the date an adopted dossier evaluation decision has been communicated to such registrants. This change follows a decision by the Board of Appeal. Tonnage band information is needed to determine the information requirements that companies must fulfil. Data Needed in Tonnage Band Downgrade Under EU REACH If registrants wish ECHA to consider a tonnage band downgrade in the decision-making process after receipt of a draft evaluation decision, registrants need to inform ECHA of this update. Taiwan Region Solicits Opinions on Amendments of Labelling and SDS Regulation for Toxic and Concerned Chemicals

Minimum dimensions of labels for containers or packaging with different capacities are proposed in line with EU CLP.  Taiwan region’s Environmental Protection Administration (EPA) issued on July 21, 2022 the draft amendments of the Toxic and Concerned Chemical Substances Labelling and SDS Regulation (hereafter referred to as the “Regulation”). The draft proposal is currently undergoing a 30-day public consultation.The Regulation was promulgated on January 13, 2020, and took effect from January 16, 2020, replacing the Toxic Chemical Substances Labelling and SDS Regulation. China Consults on Priority Chemical Substances Subject to Environmental Risk Assessment

The first batch of priority chemicals subject to environmental risk assessment is expected to be published in 2022. On July 20, 2022, China’s Ministry of Ecology and Environment (MEE) issued a notice to solicit public proposals for the first batch of priority chemical substances subject to environmental risk assessment as part of the country’s efforts to promote the control of new pollutants in China.The public can submit proposals to MEE by filling in the below two Annexes of the notice before July 31, 2022, including: Annex I – List of Proposed Chemical Substances; and Annex II – Basic Information on the Proposed Chemical Substance. New pollutants, in most cases, come from the production and use of toxic and hazardous chemicals. China Seeks Information on Three Persistent Organic Pollutants (POPs)

On July 20, 2022, China’s Ministry of Ecology and Environment (MEE) issued a notice to solicit information concerning three persistent organic pollutants (POPs), i.e., Dechlorane Plus, UV-328, and methoxychlor. ECHA: Update your EU REACH Dossiers of Substances with CLH

On July 13, 2022, European Chemical Agency (ECHA) announced that a second screening project to check companies are keeping their EU REACH registrations updated will be launched soon. The project will focus on substances with a harmonised classification (listed in Annex VI to the EU CLP regulation) and labelling (CLH) and will look at registrations where this information is not used correctly. Cases where incompliance is suspected will be passed to national enforcement authorities. The results of ECHA’s first screening project, which focused on registrations of substances that are on the REACH Authorisation List, will be published next autumn. These projects remind registrants of their obligation to keep their EU REACH registrations up to date. On July 19, 2022, the Chinese Ministry of Ecology and Environment (MEE) published a notice, announcing that 22 substances were included in the Inventory of Existing Chemical Substances (IECSC), which were under consultation from April 28 to May 13, 2022. These 22 chemical substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window.
