🇪🇺European Union EU Consults on Persistent Organic Pollutants (POPs)- Perfluoroctanoic Acid (PFOA) (May 17, 2022) The Commission aims to protect human health and the environment by eliminating or restricting the production and use of POPs, as defined in the Stockholm Convention. This act concerns PFOA, its salts and PFOA-related compounds (included in Annex I of Regulation (EU) 2019/1021). It amends the PFOA concentration as an unintentional trace contaminant in substances, mixtures and articles, and removes a specific exemption that is no longer needed in the EU. 🇨🇳Chinese Mainland China Plans to Apply Hazchem QR Codes Extensively China’s new Hazardous Chemical Registration Comprehensive Service System was launched on February 16, 2022, which supports the automatic generation of QR codes (called “hazardous chemical safety information codes”) for registered hazardous chemicals. Since the QR code cannot be generated unless the registration information is completed, information supplementation in the new system is a necessary step to enable the smooth roll-out of the QR code policy. China Released Action Plan for New Pollutants Treatment

Strengthening the source control is a major method to prevent the generation of new pollutants.   General Office of the State Council of the People\’s Republic of China officially released the approved Action Plan for New Pollutants Treatment (hereinafter referred to as the Plan), according to Notice No.15 of 2022 issued on May 24, 2022, which vows to improve China’s new pollutants treatment capacity significantly by 2025. The Plan was drafted to solicit public comments in October of 2021, which had attracted widespread attention from the industry (CL news).   What Are the New Pollutants? China Plans to Apply Hazchem QR Codes Extensively

Hazardous Chemical Safety Information QR Codes China’s new Hazardous Chemical Registration Comprehensive Service System was launched on February 16, 2022, which supports the automatic generation of QR codes (called “hazardous chemical safety information codes”) for registered hazardous chemicals. (China Hazardous Chemical Registration) Following the “One enterprise, one chemical product, and one QR code” principle, hazardous chemical management based on QR code was previously expected to be fully implemented in China this year. 17,263 Substances Pre-registered under K-REACH

On March 31, 2022, South Korea\’s Ministry of Environment (MoE) published the updated list of pre-registered substances under K-REACH. So far, a total of 212,992 pre-registration applications were submitted for 17,263 chemical substances, of which 76 are CMR substances. About 9% of the pre-registered substances are manufactured or imported over 1,000 tonnes per year. For each pre-registered existing chemical substance, the MoE provides information including  KE number, CAS number and chemical name; number of applications for pre-registration; the maximum tonnage band (1-10t/y: 6,768 substances; 10-100t/y: 5,748 substances; 100-1000t/y: 3,162 substances; Above 1000: 1,585 substances); if it is a CMR substance; if consumer uses apply; and hazard classification information. The Ministry of Environment urges the stakeholders involved with existing chemical substances to speed up the registration work before the end of grace period.

China MEE Consults on Adding 22 Substances into IECSC

On April 28, 2022, the Chinese Ministry of Ecology and Environment (MEE) published a notice to consult on the addition of 22 substances to the Inventory of Existing Chemical Substances in China (IECSC). The consultation will end on May 13, 2022. These 22 substances were manufactured in or imported into China before October 15, 2003, which fulfilled the supplementation criteria but missed the previous supplementation window. Details of these substances can be assessed here, including chemical name (both in Chinese and English), CAS number or Series number, molecular formula, structural formula, etc. They are now going to be regulated as existing chemical substances in China, and thus free from new chemical registration or notification requirements under the Measures for the Ecology and Environmental Management Registration of New Chemical Substances (MEE Order No.12).

30 Apr 2022: Deadline for Annual Reporting of China New Chemical Substances

China’s Solid Waste and Chemicals Management Center (SCC) issued a notice on January 22, 2022 to notify certificate holders to submit the annual report for 2021 through the online submission system before April 30, 2022. There’s no need to mail the original paper version. According to the notice, the 2021 annual reporting for China New Chemical Substance shall be prepared as per requirements under The Measures for the Environmental Management Registration of New Chemical Substances (Order No. 12 of the Ministry of Ecology and Environment of the P. R. China, MEE Order No. 12)  and MEE Announcement No.46 of 2020 (Transitional Arrangements for Environmental Management Registration of New Chemical Substances). South Korea Initiates MSDS Self-check Campaign, Followed by Official Inspection

On April 8, 2022, South Korea\’s Ministry of Employment and Labor announced to initiate a nationalwide supervision campaign on MSDS. Korean manufacturers and importers are required to review internal management on MSDS and fill in the self-check list from April 11, 2022, to May 31, 2022. The Basin/Regional Departments of Employment and Labor conduct spot checks from July 2022 on the compliance of units and rectify issues uncovered. The self-checklist mainly focuses on issues regarding Preparation, online submission and delivery of MSDS; Elements on MSDS (including usage, classification, name and content of components, and regulatory information) and its update; Publicity of MSDS, employee training, etc. * The self-checklist shall be signed by the legal representative and kept for inspection. EU REACH: Upcoming Changes to Information Requirements

On April 12, 2022, the European Chemicals Agency(ECHA) published the news that the European Commission has revised certain information requirements for registering chemicals under EU REACH. Companies should start to prepare as the changes will begin to apply in October 2022. ECHA will publish further advice later this year. The update of the EU REACH annexes clarifies the information companies need to submit in their registrations and makes ECHA’s evaluation practices more transparent and predictable. The changes will start to apply from 14 October 2022. Companies should get familiar with the updated annexes and prepare to review their registration dossiers.
