K-REACH: South Korea Publishes Updated List of Over 17,000 Pre-Registered Substances

South Korea\’s Ministry of Environment (MoE) has released an updated list of pre-registered substances under the K-REACH regulation. As of March 31, 2023, a total of 226,520 pre-registration applications were submitted for 17,380 chemical substances, with 77 being CMR substances. Approximately 9% of the pre-registered substances are produced or imported over 1,000t/y. The MoE provides information for each pre-registered substance, including: KE number, CAS number, and chemical name; Number of applications for pre-registration; Maximum tonnage band (1-10t/y: 6,745 substances; 10-100t/y: 5,905 substances; 100-1000t/y: 3,159 substances; Above 1000: 1,571 substances); If it is a CMR substance; Does any consumer use apply; and Hazards information. About 18% of the pre-registered substances fall within a maximum tonnage band of 100-1000t/y, and they must complete joint registration before the second registration deadline of December 31, 2024. New Hazard Classes Introduced in EU\’s CLP Regulation: What You Need to Know

The European Commission has published a Delegated Regulation amending the Classification, Labeling, and Packaging (CLP) Regulation, which sets out new hazard classes and criteria for the classification, labeling, and packaging of substances and mixtures. All manufacturers, importers, downstream users, and distributors placing substances and mixtures on the EU market must comply with the new rule. New Hazard Classes The new hazard classes include Endocrine disruption for human health in Category 1 and Category 2; Endocrine disruption for the environment in Category 1 and Category 2; PBT (persistent, bioaccumulative, toxic), vPvB (very persistent, very bioaccumulative); PMT (persistent, mobile, toxic), vPvM (very persistent, very mobile). The amended CLP Regulation came into force on April 20, 2023. China\’s New Inspection Mode to Boost Safety of Imported Hazardous Chemicals

Starting from April 13, 2023, the General Administration of Customs of China (GACC) will implement a new inspection mode, \”Document Review + Port Inspection or Destination Inspection,\” for every batch of imported hazardous chemicals across the country. The inspection locations and percentages will be determined by the GACC based on the imported hazardous chemicals\’ properties and packaging types. The GACC decided to reform the inspection process to standardize operational requirements and prevent false declarations and concealment. After a successful pilot in Shanghai and Guangzhou, the GACC decided to roll out this new inspection mode nationwide. When declaring at customs, importers of hazardous chemicals should provide truthful information on the China International Trade Single Window, including: cargo attributes, project of inspection and quarantine, hazard class, UN number, packaging group level, UN markings, and inspection and quarantine department at the destination. European Union & United Kingdom On April 12, 2023, ECHA submitted its 11th recommendation to the European Commission, which recommends the inclusion of 8 substances to the REACH Authorisation List to protect people and the environment. UK REACH: HSE Proposes Critical Management Measures to Control PFAS Use

The UK\’s Health and Safety Executive (HSE) has recently published a regulatory management options analysis (RMOA) that examines the risks associated with the use, import, and manufacture of poly- and perfluoroalkyl substances (PFAS) and recommends appropriate management options. Definition of PFAS Under RMOA PFAS are a group of man-made chemicals widely used in various industrial and consumer products due to their unique properties, but they are also known to persist in the environment and pose potential risks to human health and the ecosystem. Under this RMOA, PFAS are defined as fluorinated substances that contain at least one fully fluorinated methyl carbon atom (without any hydrogen, chlorine, bromine, or iodine atom attached to it), or two or more contiguous perfluorinated methylene groups (–CF2–). ECHA Proposes Eight Substances for Inclusion in Authorization List

Once substances are added to the list, companies will need to apply for authorisation to continue using them. On April 12, 2023, ECHA submitted its 11th recommendation to the European Commission, which recommends the inclusion of 8 substances to the REACH Authorisation List to protect people and the environment. China MEE Publishes New Chemical Record Registration Statistics in 2022 H2

By a notice issued on April 7, 2023, the Chinese Ministry of Ecology and Environment (MEE) made public 3,069 new chemical record registrations that were received in the second half of 2022, covering more than 21,600 new chemical substances. The attached list contains the applicant and the corresponding representative agent (if any), the time for record registration, the receipt number, and the number of new chemical substances. Details can be accessed here.Under MEE Order No. 12, new chemicals manufactured or imported in quantities below 1 ton per year, polymers containing less than 2% of a new chemical monomer/recant, or PLCs are subject to record registration. Notably, there’s no approval for record registration, which means that businesses can start relevant activities immediately after submitting application materials and receiving the receipt sent via the online registration system.
