[Attention] ECHA Fees are to Rise by 1.5% from 25 June

On 8 June 2015, the EU’s Official Journal announced an amendment to the Fee Regulation that ECHA will adapt the fees and charges to the 2013 inflation (+1.5%). The new fees will come into force on 25 June 2015, and all invoices for REACH will automatically reflect the new fees as of that date. TSCA Certification Statement: Your Passport to the U.S. Market

Recently, some Chinese manufacturers exporting products to the United States turned to REACH24H for help, troubled by the failure of customs clearance without a TSCA certification statement. Under Section 13 of the Toxic Substances Control Act (TSCA), chemical substances, mixtures, or articles not in compliance with TSCA, or whose importation is not in compliance with TSCA, must be denied entry into the customs territory of the United States. 40 Substances’ Evaluation Draft Decisions will be sent by ECHA

On 30 Mar 2015, ECHA announced that it will soon send the 2014 Community Rolling Action Plan (CoRAP) draft decisions to registrants. In 2014, 51 registered substances have been evaluated by the Member States. The deadline for submission to ECHA was 26 Mar 2015, and ECHA has now received draft decisions on 40 substances, and relevant registrants will get the draft decisions on 4-8 May 2015. Registrants of these substances will have 30 days to consider and submit their comments. A notification letter will specify the deadline for commenting. Among the 40 substances, registrants of one substance (EC 229-782-3) received the draft decision for comments already in 2014. The rest 39 substances with draft decisions can be found online. The remaining 11 substances do not need consultation with the registrants. For these, the evaluating Member State has been asked to submit a conclusion document within four months from the end…

[Authorisation] A Second Pilot Project is started by Forum

On 24-26 Mar 2015, the Forum for Exchange of Information on Enforcement determined on a second pilot Project on the authorized substances, and this project will focus on substances with a sunset date before 2016. Companies should notice that the inspectors will not only check whether substances on the market granted an authorization but also check whether the authorisation holders comply with the conditions of the granted authorization. Inspections will then take place during 2016 and the final report will become available in 2017. In addition, specific restriction entries for the fourth coordinated enforcement project, which are relevant for consumer articles, professional use and protection of the environment, will be chosen by the Forum. USA TSCA Compliance by Polymers: Make No Detours!

Recently, many Chinese manufacturers with the intention of exporting polymers to the United States turned to REACH24H for help, seeking for a better understanding of regulatory obligations and possible ways of polymer exemption under U.S. Toxic Substances Control Act (TSCA). In response to such customer demands, REACH24H provided customers with exclusive compliance reports based on their product information, evaluating if the polymer exemption criteria were well met and pointing out ways to proceed. TSCA Section Five stipulates that for companies intending to manufacture or import a new chemical substance in the United States for commercial purposes, a PMN (Pre-Manufacturing Notice) must be submitted to the U.S. Environmental Protection Agency (EPA) at least 90 days before manufacturing, importing, processing, or selling this specific new chemical substance. EU Commission Adopts Decisions on Authorisations for DEHP and DBP

On 17 Mar 2015, the European Commission published decisions on authorisations for DEHP and DBP for specific purposes, and the date of expiry of review period is 21 Feb 2019. ECHA Adopted the CoRAP for 2015-2017 with 134 substances to be evaluated

On 17 Mar 2015, ECHA has adopted the final Community rolling action plan (CoRAP) for 2015-2017 with 134 substances to be evaluated (CoRAP 2015-2017 list). In the coming three years, 21 Member States will carry out substance evaluation for 66 newly selected substances and 68 substances from the previous CoRAP update. From today, the Member States have one year to evaluate the 48 substances specified for 2015. Except the initial concerns on PBT2-properties, suspected endocrine disruption, or carcinogenic, mutagenic and/or reprotoxic properties in combination with wide dispersive use or consumer uses, any potential harm properties will be found or confirmed during the evaluation process. If necessary, Member States will require registrants to provide relevant further information to clarify the suspected risks related to the substances. Two potential SVHC dossiers are open to the public consultation

On 2 Mar 2015, ECHA has proposed two substances to be identified as substances of very high concern (SVHCs), and is consulting on dossiers containing proposals to identify SVHCs. Measures for the Environmental Management Registration of Hazardous Chemicals (MEP Order 22)

Overview of MEP Order 22 As further support to the implementation of China’s top level law on the control of hazardous chemicals, the State Council Decree 591, the Ministry of Environmental Protection (MEP) has issued the “Measures for the Environmental Management Registration of Hazardous Chemicals (Trial)” (known as MEP Order 22) on Oct 10, 2012, which came into force on Mar 1, 2013. 1) The Measures stipulate that the manufacturers and/or users of the hazardous chemicals in the ‘Catalogue of Hazardous Chemicals’ (HCs) and the ‘Catalogue of Hazardous Chemicals of Priority Environmental Concern’ (HCPEC) shall apply and obtain the environmental management registration certificate for manufacture and/or use of hazard chemicals. 2) Importers and/or exporters of the hazardous chemicals included in the ‘List of Toxic Chemicals Severely Restricted for Import and Export in China (2014)’ (TCSRIE) shall apply the environmental management registration on hazardous chemicals.
