Mandatory Filing Procedure for Labels of Imported Pre-packaged Foods Is Cancelled

On April 22nd, 2019, the General Administration of Customs published the Announcement No. 70 of 2019, “Announcement on Matters Concerning the Inspection and Supervision of Label Inspection of Imported and Exported Pre-packaged Foods”. From October 1st, 2019, the inspection system for labels of imported pre-packaged food moved from the standard filing procedure to a new spot-check system. The importer will bear the responsibility and will become accountable if incompliance is reported after customs clearance. Self-assessment of Labels From October 1st, 2019, the filing requirements for the labels of pre-packaged foods at the first importation will be cancelled. The importer will be responsible for ensuring the Chinese label on the imported pre-packaged food complies with relevant laws, administrative regulations and national food safety standards of China. 2019 Compliance Review: Food Regulatory Updates in China

In the past five years, China ’s retail market has experienced the miracle of digital growth. Social media,  e-commerce, and mobile payments are seamlessly connected. The purchasing decisions of consumers can be driven by KOLs, comments on the third-party platforms and personalized offers supported by big data. PwC’s Global Consumer Insights Survey found that 50% of Chinese consumers shop online every week, while 59% of Chinese consumers shop online for groceries (the average global ratio is 21 %). Food enterprises still consider China and the United States as the countries with the largest consumer markets  in the world, with the final revenue of the food industry reliant on consumer spending. Disposable income per capita in China of its overall population of 1.4 billion is on the rise, and the consumer preferences are constantly shifting due to income growth. China NHC Consults on GB 7718 General Standard for the Labeling of Prepackaged Foods and 12 Other National Food Safety Standards

Takehome: Compared to its predecessor GB 7718-2011, the new GB 7718 includes a chapter stipulating the labeling requirements of imported prepackaged food, including character requirements, ingredient list requirements, production date, shelf life, origin countries/regions, etc. Allergen labeling will become a mandatory labeling requirement for all prepackaged food products sold in China. On Dec. 31, 2019, China NHC opened 13 national food safety standards for public feedback, any feedback shall be sent back before Feb. 28, 2020.

Raw materials and claims of blue-hat nutrient supplements under consultation

Take home: Ÿ   SAMR has opened draft versions of the updated directories of raw materials and claims of health food nutrient supplements to public feedback. The consultation period will end on Dec. 31, 2019. On Dec. 2, 2019, State Administration for Market Regulation (SAMR) released consultation drafts of the Directory of Raw Materials Used in Nutrient Supplementary Health Food (2019 Edition) 《营养素补充剂保健食品原料目录(征求意见稿)(2019年版)》 and the Directory of Functional Claims Allowed in Nutrient Supplementary Health Food (2019 Edition)(2019 Edition) 《允许营养素补充剂保健食品声称的保健功能目录(征求意见稿)(2019年版). China GAC updates the list of approved overseas infant formula manufactures

On Dec. 3, 2019, China GAC updated the list of enterprises which have been granted infant formula overseas manufacturer registration approval in China. 5 countries including Ireland, Germany, France, Netherland and New Zealand are involved in the latest updates. According to “Administrative Provisions on Registrationin of Overseas Manufacturers of Imported Foods (exposure draft)” issued by GAC on Nov. 26, overseas manufacturer registration may be subject to more stringent supervision in future. Bellakt Fails to Pass China’s Infant Formula Recipe Registration

Takehome: The rate of approval of infant formula recipe registration applications is expected to slow down going forward.  As revealed by NMPA’s notice on Oct. 29 , Bellakt failed to pass China’s recipe registration for all its 3 recipes. Promulgation of Implementation Rules of Food Safety Law 2019

Takehome: Except for health food, food products are prohibited to declare any health food functional labeling/advertising claims or related terminology purporting to reduce specific disease risk factors, indicate therapeutic efficacy or amelioration of specific physiological parameters (does not apply to nutrient function claims). China Updates Health Food Functional Evaluation Requirements

Takehome: Registration of health foods will no longer be contingent on proving functional efficacy and safety through mandatory human clinical trials; however, a consumption evaluation report will still be required during product re-evaluation.
