Health Food: China Consults on Regulations on Technical Evaluation of New Functions

As per the notification released on August 2, 2022, the State Administration for Market Regulation (SAMR) unveiled the draft version of Detailed Rules on Implementation for Technical Evaluation of New Functions of Health Food (Trial) and announced to solicit public comments. Any feedback can be sent to bjspbjgn@cfe-samr.org.cn before September 1, 2022. Major Contents Revealed by the Draft  1. General Principle Any individual or unit (hereinafter referred to as the proposer) can individually or jointly put forward suggestions on new functions of health food to the food evaluation institution of SAMR (hereinafter referred to as the evaluation institution). If the proposer is an individual, it shall jointly propose with legal persons or other organizations registered in China that meet the qualifications of health food registration applicants, or overseas manufacturers of health food with new functions that has already been put on the market. 2. Health Food: Status Quo of China\’s Imported Health Food Registration/Filing in H1 2022

164 imported health food has been granted filing approvals by the end of H1 2022, while registration approval has been halted since 2018. 23 imported health food has been granted filing approvals over the past 12 months, and more can be expected. In 2017, China implemented a dual track system to regulate the market access of imported health food. The system allows imported products to enter the Chinese market by filing or registration with SAMR. Since then, every year dozens of imported products entered the market successfully. However, due to strict barriers, the registration approval for imported health food became stagnant just one year after its implementation. As a consequence, product filing becomes the only way that actually works for imported products when exporting to China. 1. GB 2762-2022: China Approves National Food Safety Standard Maximum Levels of Contaminants in Foods

The new standard revises the maximum level of lead, cadmium, mercury, arsenic, chromium, benzo[a]pyrene, and polychlorinated biphenyls in foods. Foods are now subject to stricter limits of contaminants, especially the maximum level of lead. The lead limits in most foods are tightened, including infant formula, dairy products, meat and products thereof, etc. On July 28, 2022, China’s National Health Commission (NHC) approved 36 national food safety standards and 3 amendments, involving standards for food additives, food contact materials, beverages, concentrated milk products, cheese, etc. What particularly worth mentioning is the heavily watched GB standards for contaminants, which will come into effect on June 30, 2023. China Unveils 2022 Food GB Standard Legislation Plan

Update On August 5, 2022, China NHC officially unveiled the 2022 National Food Safety Standard Legislation Plan with no changes from the draft version. It is believed that various works on the legislation plan will steadily proceed soon. Stay tuned with REACH24H for the latest progress. 36 New National Food Safety Standards and 3 Amendments Unveiled in China

NHC and SAMR unveiled a total of 36 new GB food standards and 3 amendment sheets. Several significant standards related to contaminant limits in food, beverages, cheese, concentrated milk, and food contact materials were involved. On July 28, 2022, China National Health Commission (NHC) jointly with the State Administration for Market Regulation (SAMR) unveiled 36 new national food safety standards and 3 amendment sheets. China Consults on 10 New Food Ingredients and Food-related Products

One food raw material, one food-related product and eight food additives were involved in this consultation. REACH24H, the founder of ChemLinked, successfully finished the application of a food processing aid with expanded application scope. On July 1, 2022, China National Center for Food Safety Risk Assessment (CFSA) announced to solicit public feedback for one new food raw material, one new food-related product and eight new food additives. China to Tighten Supervision over the Health Food Logo

On March 21, 2022, the State Administration for Market Regulation (SAMR) issued a drafted notice regarding the supervision over the health food logo. Comments can be sent to bjspjgc@163.com till April 21, 2022. Here are key points revealed by the proposed notice. 1. Definition of the health food logo The logo of health food is the exclusive mark for health food registered or filed in China, which shall be marked on the minimum sales package of health food products. 2. Size and location of the health food logo The logo of health food shall be the pattern specified by SAMR, and shall be marked on the top left of the main display panel of the packaging in equal proportion, and shall be clear and easy to identify. Japan Revises the Ingredient Standards for Beverage

On June 29, 2021, Japan MHLW unveiled an amendment to “Standards and criteria for food and food additives, etc.” According to the amendment, the ingredient standards of mineral water (The Japanese Food Sanitation Law classifies it in the category of beverage) were revised. Notably, in Japan the \”mineral water\” includes products sterilized and unsterilized, and each category has its own standards. Abbott Fined Nine Million Yuan for the Detection of Vanillin in Stage 1 Infant Formula

Takehome: The tiny amount of vanillin detected in the involved batch of Abbott’s stage 1 infant formula is mainly the residues in pipeline after the production of another batch of products. In 2019, 13 domestic infant formula companies in China initiated an “Anti-flavoring Action” and promised to rule out the use of flavorings in infant formula products. On May 6, 2021, Shanghai State Administration of Market Regulation (SAMR) issued the decision to fine Abbott Laboratories Trading (Shanghai) Co,.Ltd. over 9.09 million yuan (around USD 1.4 million dollars) for the detection of vanillin, a food flavoring, in its stage 1 infant formula. Besides, a total of 3.43 million yuan of illegal income would be confiscated as well.
