China State Council Passes Draft of Revised Regulations on Pesticide Administration

Mia Gao, Feb 10th, 2017 On February 8th, 2017, Premier Li Keqiang presided over an executive meeting of the State Council, during which the draft of the revised Regulations on Pesticide Administration was released. The draft document focuses on the quality and safety of agricultural products. New regulatory requirements include: The Ministry of Agriculture will be the sole regulatory authority and will be tasked with complete control of both pesticide production and management. A new business license system will be implemented. Pesticide usage will be discouraged with an emphasis placed on reducing the overall volume of pesticides used during crop cultivation. The supervision of highly toxic pesticides will be more stringent. Secondly, the pesticide producer and marketer will be responsible for the safety and efficacy of the pesticides. Brazil Pesticide Regulations

Brazil Pesticide Legislation and Implementation Agency MAPA, ANVISA and IBAMA are the main pesticide legislation and implementation agencies to supervise and manage pesticides in Brazil. Regarding pesticide registration management, firstly IBAMA will evaluate the impact on environment, ANVISA will evaluate the impact on human and MAPA will evaluate the impact on pesticides, finally MAPA will decide whether registration is required combining conclusions from IBAMA and ANVISA. Pesticide Regulations of Other Countries

Australia Pesticide Regulatory Compliance In Australia, the main pesticide legislation and implementation agency is Australian Pesticide and Veterinary Medicines Authority (APVMA), which is responsible for pesticides registration, importing, processing, storage, transportation, sales, use and law enforcement etc. The main pesticide regulation is the Agricultural and Veterinary Chemicals Act 1994. Canada Pesticide Regulatory Compliance In Canada, the main pesticide legislation and implementation agencies are Pest Management Regulatory Agency (PMRA), Canadian Food Inspection Agency (CFIA) and Provincial’s Department of Environment. The main pesticide regulation is the Pest Control Products Act. Upcoming Deadlines to Apply for Union Authorisation of Biocidal Products in 2016

Abstract: In 2016, several legal deadlines are relevant for applying for Union Authorisation of biocidal products. If the relevant Union Authorisation applications are not submitted by the deadline, the products could not be placed on the EU market until it is authorised. Enterprises should act as soon as possible in order to reduce the risk of punishment and expand the trade in EU market. Union Authorisation(UA) is a new application type under Biocidal Products Regulation (BPR, Regulation (EU) 528/2012). It allows companies to place their biocidal products on the market throughout the entire EU, without the need to obtain a specific National Authorisation. Compared with the National Authorisation and mutual recognition, Union Authorisation can reduce administrative burden, harmonisation across EU and ease of access to the EU market which make it much attractive to industry. Apply for Approval of Active Substances used for Treating Articles by 1 September 2016

Abstract: The legal deadline to apply for the approval of active substances which are used in treated articles and not yet in the approval process is 1 September 2016. If the treated articles do not meet the regulatory requirements by the deadline, they can only be placed on the market until 1 March 2017. In order to avoid the heavy penalty from the European Union and reduce the impact on the trade to the minimum, the treated articles enterprises should check the state of the active substance and prepare the special label under BPR in time. Deadlines Approaching following the Enforcement Discussion of BPR between CA of EU

Abstract: the first BPR Enforcement Group (BEG) meeting will be held on 15 March 2016 which will focus on the enforcement of Article 95(2) for biocidal products and Article 94(2) for treated articles. Abstract: the notifications of in situ generated active substances below should be submitted by 27 April 2016. Otherwise, the relevant enterprises will have to stop trading or using the combination until it is approved several years later. The companies should evaluate their products actively and design a strategy in order to reduce the compliance cost and impact on the trade to the minimum. It has been more than 2 years since Biocidal Products Regulation (BPR, Regulation (EU) 528/2012) applied from 1 September 2013. After the deadline of compliance of Article 95(2) for biocidal products on 1 September 2015, the notifications of in situ generated active substances[1] below should be submitted by 27 April 2016. China to issue new pesticide regulation by December 2012

Late last month in Nanjing, Sui Pengfei, director of ICAMA (Institute for the control of Agrochemicals, Ministry of Agriculture) revealed in an industrial conference that China to issue new regulation for pesticide and the legal text will be promulgated by December 2012 the latest. The original “Regulation on the Control of Agricultural Chemicals”, which has been operated for almost 15 years is not applicable for current circumstances as more and more HES concerns have been drawn by the public. In addition, the poor-innovative and low-efficient crop protection industry might further threaten China’s food supply and environment. China to renew its environmental labeling requirement for thermal mosquito-repellent products by setting series of technical requirements in product designing, manufacturing, limits of the hazardous substances, packaging, recycling

12 June2012, China MEP has issued a technical standard of “Technical requirement for environmental labeling products- Mosquito coils” for public comments by July 20, 2012. The drafted standard is to replace the original standard, the “The Technical Requirement for Environmental Labeling Products–Mosquito-repellent incense Coil” (HJ/T 310-2006), which was published on November 25, 2006 and came in to force on January, 1, 2007.

Though DuPont’s Rynaxypyr has been patent-protected with its debut in China 4 years ago, unceasingly illegal productions and marketing on the insecticide have been probed and sentenced since then due to the high profit after the risk. This month, two patent infringements cases with 24 million Yuan worth of the counterfeits were sentenced in Jiangsu, a strong chemical outputting province in China.
