2019 Compliance Review: Pesticides Regulatory Updates in EU and US

PRIA 4, the Pesticide Registration Improvement Extension Act (United States) is Promulgated, with Raised Pesticide Registration and Review Fees On March 8, 2019, the U.S. Environmental Protection Agency promulgated the Pesticide Registration Improvement Extension Act of 2018 (PRIA4), which will be valid for five fiscal years and will expire on September 30, 2023. 2019 Compliance Review: China Pesticides Management Updates

MoARA Designates 15 Sample Inspection Labs for Fertilizer Registration

On 3 Jan 2020, the Chinese Ministry of Agricultural and Rural Affairs announced 15 labs have passed through a qualification review. These labs will be designated as sample inspection labs for fertilizer registration for the next 3 years. In recent years, MoARA made a series of amendments to streamline the fertilizer registration process, including the cancelation of temporary registration and broadened acceptance scope of efficacy trial report. Fertilizer efficacy trial can be conducted either by the applicant or entrusted labs (CNAS and CATL qualified) and product quality test should be conducted at the same time. After receiving the application and sample from the applicant, MoARA will also organize tests on product quality and safety. Therefore, parts of the quality indicators are tested twice: one arranged by the applicant during the field trial stage and one arranged by the MoARA after receiving the application. China Pilots Quality Certificate System of Agricultural Products

On 18 Dec 2019, the Chinese Ministry of Agricultural and Rural Affairs issued the “Plan for the Trial Implementation of Quality Certificate of Agricultural Products Nationwide”, aimed to promote safety and correctly use of pesticides, veterinary drugs and other agricultural inputs. Indigenous growers and farmer above designated size need to issue the quality certificate prior to placing their agricultural products on the market. The measures will be applicable to agricultural production enterprises, farmer cooperatives and family farms of fruits, vegetables, livestock, poultry eggs and breeding aquatic products and small individual farmers are encouraged to participate. China Unveiled Guidance on Rural Industrial Revitalization

The Guidance refer to an integration, extension, refinement and confirmation of China’s existing rural revitalization guidelines which offer a precise description of industrial segments, clear distribution of tasks and responsibilities across ministries/commissions, as well as the supply of financial, land and human resources, aimed at extending the value chain and improving the quality and efficiency of agriculture-related industries. China Pesticide Registration: Risk Pre-assessment Creates Sustainable Development Opportunities

On September 13, 2017, the Ministry of Agriculture of the People’s Republic of China officially the Regulation on the Management of Pesticides which included a provision which added pesticide risk assessment reports to the pesticide registration data requirements. Although Chinese pesticide companies may already understand this new regulation, few of them were able to truly grasp the Ministry’s intention behind this measure. According to REACH24H risk assessment team’s data, more than 30% of Chinese pesticide companies have experienced wasteful registration fees and registration time since the new regulations were issued. What is more, some enterprises were forced to carry out large-scale changes and adjustments due to the inability to pass the registration review in accordance with the new regulations. South Korea to Release K-BPR Key Implementation Details

On March 20, 2018, the South Korean government officially promulgated law No. 15511 (K-BPR), which will be officially put into effect on January 1, 2019, with a sub-decree to be issued in December. On September 3, 2018, the Ministry of Environment (MoE) of South Korea held a seminar to assist with the interpretation of K-BPR and to discuss implementation details. The first Biocidal Substance Information Exchange Forum (Biocidal SIEF) was officially held on September 20-21, 2018. Biocidal SIEF is a voluntary organization of manufacturers and importers in Korea which participate in the regulatory implementation. Union Authorisation One Application for the Whole European Union

EU formally renews active substances Forchlorfenuron and Zoxamide. Herbicide Flurtamone will be withdrawn from EU market

The EU Recently published official announcements approving the re-approval of the application of the plant growth regulator Forchlorfenuron (CAS No 68157-60-8) and the fungicide Zoxamide (CAS No 156052-68-5) under Regulation (EC) 1107/2009. The approved Active Substance Checklist (EU) 540/2011 will be amended accordingly. A detailed description can be found in the COMMISSION IMPLEMENTING REGULATION (EU) 2018/679 and (EU) 2018/692.
