EU REACH

Overview REACH is the European Regulation on chemicals and their safe use. REACH stands for Registration, Evaluation, Authorisation and Restriction of Chemicals. The REACH regulation came into force in 1 Jun 2007, establishing a uniform system for the control of chemicals manufactured or imported to the EU.Following the introduction of REACH, chemical substances on their own or in mixtures, manufactured or imported to the EU in quantities at above 1 tonne a year must be registered with the European Chemicals Agency (ECHA). This obligation also applies in certain cases to substances in articles. Failure to register means the company is no longer allowed to manufacture the substance in or import it to the EU. China Pesticides

In China, pesticides are mainly managed by the Regulation on “Pesticide Administration” (Decree No. 326). The Regulation is promulgated by the State Council of P.R. China to supervise and control manufacturing, distributing and use of pesticides in China. It entered into force on May 8, 1997, and was initially revised on 29th November 2001 according to the decision of China State Council. Currently it is under the second revision. China GHS

GHS Overview The Globally Harmonized System of Classification and Labelling of Chemicals (GHS) (“Purple Book”) is a guidance document published in 2003 by the United Nations (also referred to as the UN GHS). An updated edition of the GHS is published by the United Nations every two years (as of publication of this brochure, 2017 is the 7th and most recent revised edition). The 2002 United Nations World Summit on Sustainable Development (WSSD) encouraged countries to implement GHS before 2008. In order to ensure consistency with UN GHS, individual countries have gradually enacted corresponding implementation regulations, among them the European Union’s (EU) release of its Classification, Labelling and Packaging (CLP) Regulation in 2008, followed by China’s implementation of GHS in 2011, and the United States modified Hazard Communication Standard (HCS) in 2012. Hazardous Chemical Registration in China

Overview July 1, 2012, China State Administration of Work Safety published the final version of the revised Measures for the Administration of Registration of Hazardous Chemicals (SAWS Order 53). As one main supporting law under the Decree 591, this revised regulation has taken effect since August 1st 2012 and replaced its predecessor version that had been released in 2002 by the former State Economic Trade Commission, a comprehensive administration set up in 1993 and repealed in 2003. SAWS Order 53 establishes a powerful database of hazardous chemicals by adopting the internationally accepted registration system on hazardous chemicals, and provides technical and informative support for management on hazardous chemicals, accident prevention and emergency rescue. ECHA released IUCLID 5.5 enabling application of Biocidal Product registration

On April 2nd 2013, ECHA released the updated version of IUCID software—IUCID 5.5, which enables applicant of Biocidals (i.e. biocidal product) to compile application dossiers on it. The new regulation on Biocidals will come into force on September 1st 2013 after which active substances used in production of biocidals must be authorised. The newly updated IUCLID is designed for companies who may use it to compile production application dossiers of active substances used in biocidals. The format of application dossier created on IUCLID 5.5 fits the criteria and requirements outlined in the regulation on biocidals. Applicants may take the regulation as guidance while compiling the dossiers on IUCLID 5.5, which makes the work easier. Later, ECHA will also release detailed guidance document regarding compilation of production application dossier of active substance used in bocidals. Four Unified Supporting Documents for Environmental Management Registration of HC Established

On 22 March 2013, the MEP published four supporting document for environmental management registration of hazardous chemicals. The MEP promulgated the Order 22, “Measures for the Environmental Management Registration of Hazardous Chemicals (Trial)” on Oct 10, 2012. The HC companies should obtain registration certification for environmental management from the MEP and the companies of hazardous chemical of high environmental concern (HCPEC) are further required to conduct the environmental risk assessment. With its effectiveness on 1 March 2013, four supporting documents have been released to guide the practical registration work.

New Rules for Evaluating the Transport Conditions of Goods Carried by Vessels

China Maritime Safety Administration (MSA) issued on 31 Nov 2012 the Administrative Measures for the Determination of Appraisal Institutions of Transport Conditions of Goods Carried by Vessels as the guidance for provincial MSAs to evaluate the appraisal institutions. New MEP Rules on the Import of Waste Plastics for Four Types of Processing Companies

18 January, China’s Ministry of Environmental Protection (MEP) published in the Announcement No. 3 of 2013 new rules on the environmental management of the importation of waste plastics. Taking effect from 1 Apr 2013, the legislation has defined four types of processing and recycling enterprises which are allowed to import waste plastics as raw materials in their reproduction.
