The Briefing of Food Contact recycled plastics Registration in US

Author: Wu Li, REACH24H Consulting Group, Hang Zhou Since May 10, 2016, in Ecotech® Consumer Products, recycled plastic products polypropylene (PP) and High density polyethylene (HDPE) has received assessment of the US FDA, and 193 recycled plastic products have received US FDA’s No-objection letter, wherein PET products are 130, accounting for 67.35%; followed by polyethylene products, there are 15 products accounting for 0.07%, in addition to PC, PS, PP, HDPE, LDPE and so on. US FDA has been actively encouraging for plastic packaging materials for recycling and reuse, but what can’t be ignored is that the recycled plastic applied to food packaging still remains many health and safety issues. Therefore, the FDA issued “Guidance for Industry: Use of Recycled Plastics in Food Packaging: Chemistry Considerations” to guide compliance of recycled plastics in food contact in 2006. Regulations Interpretation of EU Regulation EC No 282/2008 on recycled plastics

FDA approved two food contact substances notification (FCN) in April

According to the US FDA official website, FDA has approved two food contact substances notification (FCN) in April, respectively: Poly[(butylenesuccinate)-co-adipate] cross-linked with malic acid by PTT MCC Biochem Company Limited , and peroxyacetic acid (CAS Reg. No. 79-21-0 ), hydrogen peroxide (CAS Reg. No . 7722-84-1), acetic acid (CAS Reg. No. 64-19-7), 1-hydroxyethylidene-1,1-diphosphonic acid (HEDP) (CAS Reg. No. 2809-21-4), dipicolinic acid (CAS Reg. No. 499-83-2) , and sodium hydroxide (CAS Reg. No. 1310-73-2) form a mixture by Solvay Chemicals. FCN program is a way to apply for new substances in United States, which is only effective on annunciators, manufacturers and suppliers in which FCN involves. The notice will contain the contents of the intended use and the use specification of restricted substances. FDA will review phthalates safety by 10 NGO application

FDA will publish a notice to announcing the petition is under review and make a decision during the following 180 days. Phthalates has been used as plasticizers, binders, coating agents and in food contact paper and paperboard, plastics and other articles. There is limited knowledge about the safety about phthalates, but some evidence showed that this kind of substance have serious affect to pregnant woman, infant, and children. In addition, this petition also including ask FDA to remove 5 phthalates from the prior-sanctioned substance (21 CFR part 181.27) and ban another 8 phthalates by update 21 CFR prat 189. Safety assessment of the substance α-tocopherol acetate for use in food contact materials

EFSA Panel on Food Contact Materials, Enzymes, Flavourings and Processing Aids (CEF) dealed with the safety assessment of α-tocopherol acetate, CAS Nos 7695-91-2 and 58-95-7, and FCM No 1055, as an antioxidant for its use in polyolefins intended for contact with all food types under any time and temperature conditions recently. The acetate is intended to hydrolyse with moisture in situ in the plastic and the active antioxidant in the plastic is the free α-tocopherol and acetice， which are both authorised without restrictions under Regulation (EU) No 10/2011. dl-α-Tocopherol and acetic acid are authorised food additives under Regulation (EC) No 1333/2008 and toxicological data were available for tocopherols that were evaluated as food additives in 2015 (EFSA ANS Panel, 2015). Regulation on bisphenol A (BPA) will be modified by EU

The EU has proposed a draft regulation which has been circulated by the WTO, it claims that the migration limitation of BPA will be changed from 0.6mg/kg to 0.05 mg/kg of food. This specific migration limitation is also suitable for coating and varnished. The draft regulation claims that BPA is used in the manufacture of certain materials and articles intended to come into contact with food, such as polycarbonate plastic and epoxy resins used in varnishes and coatings. Small quantities of BPA can migrate into the food from the material or article when they are in contact with food, resulting in some exposure to BPA for consumers of those foods. Is Bisphenol S unsafe used in food contact material as a substitute of Bisphenol A?

Recently, a research which named ‘Actions of Bisphenol A and Bisphenol S on the Reproductive Neuroendocrine System During Early Development in Zebrafish’ has been published on the ‘Endocrinology’. The authors of this research reported that the BPS has the similar effect on the reproductive neuroendocrine system during early development in Zebarfish as BPA. BPA, a widely known endocrine disrupting chemical, is a constituent of plastic polycarbonate and epoxy resins, which are widely used to produce plastic food and beverage container, paints, adhesives, medical device and food packaging. There are extensive researches showed that BPA could have an effect on human reproductive function, specifically by altering circulating steroid hormones, cancer, obesity and the health of infant and children. 5 New Food Additives are Approved for Use

An approval notice of 5 new food additives for use and an adjustment for other 28 food additives was currently released by MOH.

5 new food additives have been approved for use by the Ministry of Health (MOH) in accordance with the Food Safety Law (Order of the President No.9) and Administrative Measures for New Food Additives (Order No.73 of MOH). Along with the approval notice released on 27 August 2012, MOH also approved an expansion of use scope and dosage for other 13 food additives, 5 food processing aids, and 8 nutritional fortification substances, besides, a supplement of quality specifications for GDL(Glucono–δ—Lactone) and raw materials sources for Protease. For detailed functions, use scope, dosage, quality specifications (production process, technical requirements, sensory requirements, physic-chemical index, etc.) and test methods of the corresponding food additives please refer to Appendix to the notice.
