China’s Newly Revised Safe Production Law to Take Effect in September

On June 10, 2021, a revision to the Safe Production Law of the People’s Republic of China was adopted at a meeting of China’s top legislative body. The newly revised law is set to take effect starting from September 1 this year. Three rounds of public consultation were conducted on the revision, and the latest one was opened earlier in February this year (see ChemLinked news [1]). At a press conference held on the morning of June 11, an official from the Ministry of Emergency Management (MEM) noted that the revision has improved the responsibility system for production safety. For instance, it clarifies the regulatory responsibilities of local governments and relevant authorities and aims to ensure that production and operations entities fulfill primary responsibilities for production safety. Taiwan Consults on Extending PECs Registration Deadline to the End of 2023

The registration deadline of 106 PECs will be extended due to the COVID-19 pandemic. Registrants can obtain a registration code even if they don’t submit hazard and exposure assessment information. A draft amendment to Taiwan’s New and Existing Chemical Registration Regulation was recently issued for a 60-day public consultation. The draft amendment if approved will grant an extended deadline for the registration of 106 priority existing chemicals (PECs). In addition, some significant changes to exemptions, data submission, registration validity, confidentiality validity, review period, etc. are proposed. Korean MSDS Submission

On January 15 of 2019, the Ministry of Employment and Labor (MoEL) made a comprehensive amendment to the Occupational Safety and Health Act (OSHA). Compared with the previous act, three new regulations were proposed for MSDS submission, CBI application, and agent appointment will be officially implemented on January 16 of 2021. Manufacturers outside South Korea can appoint domestic agents in Korea who meet the requirements of the Ministry of Employment and Labor to complete related matters of MSDS submission and CBI application. Korean MSDS Submission Chemical substances subject to MSDS Substances/mixtures containing harmful factors (Article 104 of the OSHA) are referred to as Chemical substances subject to MSDS, and an MSDS must be prepared and submitted. Attention! Netherland launched Regulatory Inspection and Enforcement

In March 2021, the Dutch authorities officially launched the regulatory inspection and enforcement which required OR and the enterprises to cooperate and complete the enforcement inspection. Characteristic of Regulatory Inspection and Enforcement Function Making decisions on whether compliance has been achieved or whether action is required per the legislation or regulations. Actions could include sending letters indicating remedial steps to be taken, enforcing penalties, filing charges through the court system, and shutting down non-compliant operations. MOT Official Addresses Industry Concerns over Road Transport of Dangerous Goods Packed in LQ and EQ

On December 1st, 2020, Mr. Wu Jinzhong from the Highway Research Institute under the Ministry of Transport (MOT) introduced the highlights of the Measures for Safety Administration of Road Transport of Dangerous Goods [1], which was introduced in late 2019 and took effect on January 1st this year (for more details, see CL news [2]), at CRAC-HCF 2020 [3]. Notably, he laid particular emphasis on the exemption granted to dangerous goods packed in limited quantities (LQ) and excepted quantities (EQ) in the Measures. In recent years, the transport of dangerous goods with low hazards and in small quantities has always been a topic of heated discussion in the industry. If such goods can be transported using reliable and durable packages or following certain conditions, they will pose much less danger. China Heads Towards Risk-oriented Registration of Hazardous Chemicals, Says MEM Official

On November 30th, 2020, at the CRAC-HCF 2020 Virtual Forum [1] by REACH24H, Mr. Chen Jun, an official from the National Registration Center for Chemicals (NRCC) of the Ministry of Emergency Management (MEM), unfolded a roadmap of the reform of the registration framework regulating hazardous chemicals and relevant businesses. Mr. Chen Jun had also previously responded to comments on the proposed revisions to the Implementation Guidance of the 2015 Inventory of Hazardous Chemicals as seen here. China has been practicing the registration management of hazardous chemicals for nearly a decade. MEM Official Responds to Comments on Proposed Revision to the Implementation Guidance of the 2015 Inventory of Hazardous Chemicals

On November 30th, 2020, Mr. Chen Jun, official from the National Registration Center for Chemicals (NRCC) of the Ministry of Emergency Management (MEM), articulated informative responses to the solicited comments on the proposed revisions to the Implementation Guidance of the 2015 Inventory of Hazardous Chemicals [1] during the CRAC-HCF 2020 [2] by REACH24H. Mr. Chen reviewed the background and rationales of the proposed revision, which was released in August this year, and detailed major adjustments made in it (see CL news [3] for more details). Observe the Trend of China’s Management on Solid Waste and Hazardous Waste

On April 29, 2020, the revised Law of the People’s Republic China on the Prevention and Control of Environmental Pollution Caused by Solid Waste was approved by the National People Commission Standing Committee, and it entered into effect on September 1st, 2020 (ChemLinked News [1]). Understanding Newly Introduced Guidance for MEE Order No. 12: Part I

On November 17th, 2020, the Chinese Ministry of Ecology and Environment (MEE) published the Guidance on Environmental Management Registration of New Chemical Substances[1], along with tables used in registration of new chemical substances and instructions for filling them in. The Guidance is a normative document dedicated to supporting the implementation of MEE Order No. 12 [3], which will replace MEP Order No. 7 next year. India Expects REACH-like Regulation on Chemical Management

Mr. Shisher Kumra, representing Global Product Compliance Group, introduced the fifth and latest draft of India’s upcoming Chemicals Management and Safety Rules (CMS Rules) at the CRAC-HCF 2020 Virtual Forum held by REACH24H on November 25, 2020. This draft regulation adopts several of the same principles and concepts of EU REACH and thus has been dubbed as India REACH. Mr. Kumra assumed that the CMS Rules will be finalized soon and come into force early 2021.Drafting the new CMS rules has taken years as the intention is for it to manage chemicals overall.
