South Korea Clarifies Submission Deadlines for 5 Types of Existing Active Biocidal Substance

On September 6, 2021, the South Korean online chemical management system CHEMP disclosed the latest instruction from the Environmental Ministry, clarifying the formality deadline for 5 types of existing biocidal active substances which need to be approved by December 31, 2022, including disinfectants, algaecides, rodenticides, insecticides, and repellents. Relative importers and manufacturers need to submit the notification application and application plan by September 30, 2021, and the whole dossier for substance approval by October 31, 2021. Considering of the process of the whole registration, at least 18 months will be required for the completeness check, technical assessment, and other formalities and implicit description on the final deadline causing a relatively slow response from the industry. Brands Authorize Factories to Register/Notify Cosmetics in China, Is It Compliant?

China Cosmetic Supervision and Administration Regulation was officially implemented on January 1, 2021. A series of subsidiary regulations have been released continuously, making more scientific and rigorous adjustments to all aspects of the cosmetic industry. The new regulations introduced the concept of “registrant/notifier\”, the entity that obtains the registration / notification certificate. The registrant/notifier shall set up a person in charge of quality and safety, establish a production quality management system, put the product on the market, and be responsible for the product\’s quality, safety, and efficacy claims. However, the shortage of person in charge of quality and safety in China has plagued brands that entrust factories to produce cosmetics. In response to this problem, some brands choose to transfer the registration / notification right to factories that have been equipped with person in charge of quality and safety. Shanghai Consults on Use Safety Management Guidelines of Hazardous Chemicals in Industrial and Trade Enterprises

On August 23, 2021, Shanghai Emergency Management Bureau issued a notice to seek public feedback on the draft Guidelines for the Use Safety Management of Hazardous Chemicals in Industrial and Trade Enterprises in Shanghai (Trial) (hereafter referred to as the Guidelines). The consultation will end on October 10, 2021. Given many problems encountered by industrial and trade enterprises in safe use of hazardous chemicals, e.g., insufficient awareness of the dangers of hazardous chemicals among the responsible persons and safety managers of enterprises, inadequate capacity of enterprises to manage and control the use of hazardous chemicals, etc., more and more provinces and cities are implementing local regulations to improve the use safety management of hazardous chemicals in practice. For example, Zhejiang has issued and implemented similar guidelines in 2020. CSAR Subsidiary Regulations: China to Implement Supervision and Administration Measures on Cosmetics Manufacture and Operation

On Aug. 2, 2021, China State Administration for Market Regulation released the finalized Supervision and Administration Measures on Cosmetics Manufacture and Operation (hereafter referred to as “Measures”), which will come into force on Jan. 1, 2022.  The Measures consists of 7 chapters with 66 provisions, detailing cosmetic manufacture and operation management. Highlights include: Optimizing production license management system; Refining and clarifying the production management requirements; Refining and clarifying the operation management requirements; Strengthening the supervisory responsibilities of the administration department. China Legislates on Dust Explosion Protection for Industry and Trade Enterprises

On August 2nd, 2021, the China Ministry of Emergency Management (MEM) issued its Order No.6 [1] to publish the Safety Regulations on Dust Explosion Protection for Industry and Trade Enterprises. The Regulations are formulated in accordance with the newly issued Work Safety Law and will enter into effect on September 1st, 2021, simultaneously with the Law. The Regulations consist of five chapters as follows: Chapter 1 General Provisions, which specifies the background, terms and definitions, main responsibilities, and authorities; Chapter 2 Guarantee of Safe Production, which specifies the person responsible for dust explosion protection, the safety management system, risk factors identification, explosion-proof measures, etc. Chapter 3 Supervision and Inspection, which specifies the responsibilities of authorities on inspections, key inspection items, testing and examination, etc. Chapter 4 Legal Responsibilities, which specifies the violation circumstances and corresponding penalties; Chapter 5 Supplementary Provisions, which specifies that the implementation date of the Regulations. South Korea NIER Released Data Exemption Criteria for 8 Rodenticides and Preservatives

On June 4, the South Korean National Institute of Environmental Research (NIER) released the required/excepted data items of 8 rodenticides and preservatives to be approved through the simplified process, as well as the exemption details for the 2nd batch of disinfectants and insecticides. China’s Newly Revised Safe Production Law to Take Effect in September

On June 10, 2021, a revision to the Safe Production Law of the People’s Republic of China was adopted at a meeting of China’s top legislative body. The newly revised law is set to take effect starting from September 1 this year. Three rounds of public consultation were conducted on the revision, and the latest one was opened earlier in February this year (see ChemLinked news [1]). At a press conference held on the morning of June 11, an official from the Ministry of Emergency Management (MEM) noted that the revision has improved the responsibility system for production safety. For instance, it clarifies the regulatory responsibilities of local governments and relevant authorities and aims to ensure that production and operations entities fulfill primary responsibilities for production safety. Taiwan Consults on Extending PECs Registration Deadline to the End of 2023

The registration deadline of 106 PECs will be extended due to the COVID-19 pandemic. Registrants can obtain a registration code even if they don’t submit hazard and exposure assessment information. A draft amendment to Taiwan’s New and Existing Chemical Registration Regulation was recently issued for a 60-day public consultation. The draft amendment if approved will grant an extended deadline for the registration of 106 priority existing chemicals (PECs). In addition, some significant changes to exemptions, data submission, registration validity, confidentiality validity, review period, etc. are proposed. Canada Concludes Final Re-evaluation Decision for Imidacloprid

On May 19, Health Canada published the its final re-evaluation decision regarding the risks to human health and environment from the neonicotinoid pesticide imidacloprid. Neonicotinoids are a group of pesticides used in agriculture to protect crops from various insects. Imidacloprid is commonly applied using ground, aerial and seed treatment equipment, tree injection applicators, bait stations, and spot-on application to pets. Neonicotinoid pesticides have been used in agriculture on a wide variety of crops since the 1990s. In Canada, there are three main neonicotinoids currently approved for agricultural use: imidacloprid, clothianidin, and thiamethoxam. On November 23, 2016, Health Canada issued the proposed re-evaluation decision for imidacloprid and consulted publicly on the proposal to cancel all agricultural uses and many non-agricultural uses of this pesticide. Brazilian Agrochemical Application Area up 7 percent in Q1, 2021

According to a survey commissioned by SINDIVEG (Brazilian National Union of the Industry of Products for Plant Defense), agrochemical treated area grow by 7% to 562.72 million hectares during the first quarter of 2021, driven by higher cultivated area, the larger volume of products and increased applications carried out. In terms of volume, 349 000 tons of agrochemicals were used, up 4.8% compared with the same period in 2020 of 333,000 tons.
