Canadian Environmental Protection Act

Canadian Environmental Protection Act, 1999 (Hereafter referred to as “the Act”) came into force on March 31, 2000. It gives Canadian government the authority to address pollution issues, to manage the very toxic substance and manage the substance in and out Canada. The Act powers for all phases of the life cycle of a substance or product containing a substance (e.g. Manufacture, import, release, use, etc.). The Act also gives the Minister authority to maintain a Domestic Substances List (DSL). Substances listed on DSL are treated as Existing Chemical Substances in Canada and are managed by the Minister. Their toxicity evaluation and hazard assessment are done by Canada government. Meanwhile, substances that are not listed on DSL are treated as new substances and need file new substance notification. China Disinfectants

Pursuant to the “Decision of the State Council on Cancellation and Transfer of 50 Items of Administrative Permits and Other Affairs”, Decree 27 of 2013, approval of disinfectants and disinfection devices not produced by the use of new materials, new technologies and new principles of sterilization was canceled by the National Health and Family Planning Commission (the former Ministry of Health). Under this newly deregulated market, when these disinfectants and disinfection devices are traded on the Chinese market they are now required to implement the hygiene and safety assessment on the basis of the national hygiene standards and technical specifications. Globally Harmonized System (GHS) for Hazard Classification and Labelling – Potential Misconceptions and Challenges Ahead

Origins of GHS

The origins of GHS can be traced back to 1989 when the International Labor Organization (ILO) adopted a Resolution pertaining to the harmonization of systems of classification and labeling for the use of hazardous chemicals at work, which was followed a year later with a Convention (No.170) and a Recommendation (No.177) concerning safety in the use of chemicals at work (1). Countries adopting this convention were required to have a system in place for hazard classification and labeling. This international instrument laid the cornerstone for subsequent developments culminating in the UN Conference on the Environment and Development, Rio 1992, whereby GHS was endorsed as a priority for international cooperation (2). The first edition of GHS, which was intended to serve as the initial basis for the global implementation of the system, was approved by the Committee of Experts at its first session in 2002 and published in 2003 (3). Since then, the GHS has been updated, revised and improved every two years as needs arise and experience is gained in its implementation.

Regulations on the Control over Safety of Hazardous Chemicals (China State Council [2011] Decree No. 591)

On 11 March 2011, the Chinese State Council issued the revised version of Regulations on the Control over Safety of Hazardous Chemicals (Decree No. 591). The regulation, which addresses the safe management of hazardous chemicals during their production, storage, use, operation (sales and import) and transport, will be put into effect on the 1st December 2011. Background of Decree No. 591   The regulation was initially enacted in 1987 and has gone through two modifications, in 2002 and 2011. The earliest version has been expanded from 42 to 102 articles, combined with 4 supporting measures and a group of technical GB standards. Therefore the 2011 version is regarded as the most comprehensive law regulating existing chemicals in China. It is also the main legislation for implementing GHS in China. Registration Procedure for Pesticides in China   There are generally 3 phases for the registration of pesticides in China: Field Trial, Temporary Registration and Full Registration. Registration of a new pesticide, within a protection period or a new preparation, should apply for all these phases. If the applicant wants to skip the Field Trial and Temporary Registration phases, and apply for Full Registration directly, data is required for all these three phases and should be submitted all at once when applying for Full Registration.
