China SAWS released on 25 Feb the updated Catalogue of industries applicable for Hazardous Chemicals Safe Use Permit 2013 (hereinafter as “Catalogue”) to replace its previous version issued in 2011.
Companies that are included in the Catalogue and use HCs (for production purpose) with use quantities reaching the threshold annual tonnage specified in the “Use quantities standard for hazardous chemicals” are required to obtain the HCs Safety Use Permit, according to the SAWS Order 57 (Chemlinked news on 29 Nov 2012).
The Catalogue 2011 contains 3 main industries, which are divided into 12 sub-categories with 38 types of products. Compared with it, the newly-updated version has cut two sub-categories and 13 specific products shown below:

By the end of 2012, Hannah Zhuang the regulatory specialist took a seven-day travel across Germany and Switzerland to bring local companies with the latest trend and updates on Chinese chemical regulation. One of the most important schedules was to attend the users’ conference of PES-Ingenieurgesellschaft mbH, the SDS authoring software company. Hannah was invited to give a speech regarding Chinese regulations at the conference. 140 people in total attended the conference with all of them representatives from local German companies or those from neighboring countries. Hannah’s speech was aiming at providing compliance advices from the perspective of German companies.

After soliciting modification proposals since this July, the SAWS (State Administration of Work Safety of P.R.C.) has officially published the relevant 8 documents for hazardous chemical registration on October 17th. The full package of the documents as the supportive forms of Measures of the Administration of Hazardous Chemical Registration also known as SAWS Order 53 updated in July for short have been available and come into force since October 15th 2012.

Shortly after the effectiveness of the updated management measures on China’s hazardous chemicals registration, SAWS has published last Friday on its website the revised “Measures for the Administration of Hazardous Chemicals Operation Permit” (SAWS Order 55 of 2012) and announced that the updated legislation would enter into force as of September 1, 2012. The new rules will replace the old 2002 version that had been issued by the State Economic Trade Commission (SETC). The hazardous chemicals operation permit or license (in short as “HC Operation Permit”) is one important part that underlines the License system of State Council Decree 591; it is also one core regulatory obligation targeting enterprises of hazardous chemicals operation under China’s hazardous chemicals safety control regime.

China SAWS updates the Measures on Hazardous Chemicals Registration today; major changes take place in subject applicants, scope of substances and the registration content, etc.

Subsequent to near 10 years’ practice of the existing registration model for hazardous chemicals, the China State Administration of Work Safety has published today the updated edition of the “Measures for the Administration of Hazardous Chemicals Registration” (SAWS Order 53 of 2012). Hazardous chemicals importers have been incorporated into the registration obligation for the first time. The revision greatly promotes the implementation of GHS in China. Affected importers are now obliged to register the hazardous chemicals, prior to its first import in China, with local registration offices affiliated to their corresponding competent authorities of work safety. They will also face an escalated compliance urgency on GHS hazard classification, labelling, SDS making/updating and more visible regulatory concerns like hazard identification and risk control measures.

21 June 2012, the Chinese State Administration of Work Safety (SAWS) has issued a notice (SAWS Notice 79-2012) to reinforce the supervision and administration over domestic non-drug precursor chemicals. The No 79 notice proposed 15 instruction opinions in aspects of stricter source control, production and distribution licensing enhancement and examination, practice of responsibility management in enterprises, whole supply chain track-control system, improved precursor chemical data management and rigorous crack-down on related crimes.

Last week, China Ministry of Transportation announced an official letter to its provincial bureau, Transportation Department of Gansu, ruled that seizure of the 77.5% dichlorvos EC from Nantong Jiangshan by Gansu local transportation administration in late April was inappropriate and the authority should release the pesticide goods soon.
