State Pesticide Registration in the U.S. : Key Requirements and Compliance Challenges

Overview of State Pesticide Registration Regulations

According to the U.S. Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), all pesticide products must complete state-specific registration requirements before entering the U.S. market.

Which Pesticide Products Require State Registration?

  • End-Use Product (EP)
  • Manufacturing-Use Product (MP)
  • Minimum Risk Pesticides 25(b)
  • Devices
  • Adjuvants

Challenges in State Pesticide Registration

Each state in the U.S. has its own regulatory approach for different types of pesticides. There are significant differences in documentation requirements, submission methods, review fees, and review periods. For instance, review fees can range from hundreds of dollars to over a thousand dollars, and review periods can vary from weeks to months. Except for California, which has more stringent data requirements and conducts a thorough data review, most states only require the submission of the market label and review fee. Thus, state registration becomes a significant challenge for companies seeking to enter the U.S. market.

FAQ

If the primary registered pesticide product has already completed state registration, can the distributor’s product be sold directly?

No. In the state, primary registered products and distributor products must be registered separately and are issued individual registration certificates.

If a pesticide product is sold online, does it still require state registration?

Yes, regardless of whether the pesticide product is sold online or offline, if it is entering the U.S. market, it must complete state registration in the respective state.

How long is the validity of a U.S. pesticide product state registration?

The validity period for registration certificates varies by state. Most states have a 1-year validity, with some extending up to 3 years. Additionally, renewal periods differ by state, and Ruiou will notify clients ahead of the expiration date to facilitate renewals.

Do devices and minimum-risk pesticides, which are not required to be registered with the EPA, still need to be registered in individual states?

Some states still require devices and minimum-risk pesticides to be registered, while other states may allow them to be sold directly as long as the product label complies with regulatory requirements. For devices, once approved by the state of Hawaii, the registration certificate remains valid permanently. For minimum-risk pesticides, certain states may approve registration without charging a review fee.
