Background

In line with the Polish government’s active role in furthering business development and growth opportunities across industries, China’s “The Belt and Road Initiative” (B&R) represents one of the most valuable sources, paving the way for Polish companies from main industries (like food, cosmetics, healthy life related products, jewelry, etc.) to enter the Chinese market. Following these guidelines, the Polish Investment and Trade Agency (PAiH) has established a program named “GO China”, which incentivizes Polish companies from various industries to innovate, participate in more fairs and events in China, and fully enter Chinese market.

For this event, PAiH has invited experts from the consulting group Reach24h to introduce Chinese regulations to Polish cosmetic companies, thus allowing them to learn about the Chinese market, current opportunities, challenges, and ultimately, provide them with the necessary tools to successfully enter this exciting and continuously expanding market.

The 10th International Conference on the Implementation of Global Chemical Safety Regulation in Russia and CIS Corporations is set to take place on April 11-13 in the city of Madrid, Spain. The event is expected to receive professionals from various fields, government representatives, regulatory agency specialists, associations, institutes and research centers from across the globe to discuss the latest regulatory developments in the chemical industry.

In order to expand this event’s regulatory focus and support multilateral discussions, REACH24H will be holding two sessions.

Due to the growing role of China in terms of global trade and business opportunities, understanding the current status of Chemical regulations in China will still be one of the relevant points of the conference. Therefore, on April 11, REACH24H has been invited to hold a Workshop session which will introduce professionals to Asia- Pacific chemical regulations. Specific content on GHS and EHS in China will aim to cover latest changes and ensure attendees get an insight into this complex system. Background

In order to improve the quality and safety of agricultural products, the Ministry of Agriculture (MOA) of China has spent considerable effort revising its most relevant regulations. This revision process led to the new Regulation on Pesticide Administration (RPA) and its Implementation Rules, which took effect in 2017. The new RPA and its implementation rules significantly changed the registration process and labeling requirements of pesticides, enhancing the management of highly toxic pesticides, including increased fines and blacklisting. Meanwhile, the Management Measures of Fertilizer Registration also underwent significant revisions at the end of 2017. Temporary registrations were removed, and fertilizer samples are now required for re-testing in designated laboratories to ensure quality.

All these latest changes have made the regulatory compliance process of pesticides and fertilizers in China much stricter and more complicated. To help professionals navigate this new landscape, this free workshop will offer an updated and detailed interpretation of changes on China’s regulation on pesticide and fertilizer administration, and provide them with key elements to determine a tactical and effective strategic implementation for the registration of pesticides and fertilizers in China.

Shanghai, March 9, 2018. With the China International Agrochemical & Crop Protection Exhibition (CAC) finishing its most recent edition in the city of Shanghai, REACH24H renewed its presence, participating with its own booth supported by the main experts from the agrochemicals division. Located in the N3 Pavilion, composed largely of international agrochemical and crop protection enterprises, REACH24H was able to hold exchanges and visits from existing, new and potential partners, clients and other professionals in the field. The event also allowed for the company to attend and actively contribute to many international-level discussion panels and seminars which focused on the latest advances of the pesticide industry, new technologies, trade and regulatory updates and implications in the field of agrochemicals.

As a highlight, REACH24 was selected and awarded with the CAC2018 Recommended Supplier. This award meant a special recognition for the continuous efforts devoted to providing first-level technical consulting services to international and domestic enterprises alike on agrochemical regulations. GlobalChem 2018 successfully concludes in Washington DC., marked by a presentation by Mr. Robert Kiefer, manager of REACH24H USA.

On 28th Feb, the first day of GlobalChem, in the Fundamentals Workshop, Mr. Robert Kiefer, Manager of REACH24H USA delivered a presentation on the topic “China’s New Chemical Substance Notification Updates & Revision to Taiwan TCSCA Regulations”. In the first part of his presentation, he addressed the New Chemical Substance Notification system currently in effect in China. He specifically highlighted the latest amendments on data requirements in China’s New Chemical Substance Notification Guidance. Following this topic, Mr.Kiefer moved on to introduce the new working plan to revise MEP Order No. 7 which took effect in 2017. The purpose of this plan is to improve the environmental management system for new chemicals to prevent and control risks presented by new chemicals while still promoting green industries. Here are the key thoughts and considerations going into the revision:

  • Highlight and further focus on PBT substances and environmental emission data;
  • Adjust the classified management categories to the following 3 types – Concern, Restriction, Ban;
  • Optimize & simplify the notification type and procedures;
  • Authorize internal technical review to SCC-MEP (rather than part-time expert review teams);
  • Increase the responsibilities of the industry, strengthen checking and investigation of notification, impose severe penalties to violators;

Also, Mr.Kiefer linked the amendments to the management of existing chemicals and reviewed the overall chemical regulations and updates in 2017 in China.

In the second part of the presentation, Mr.Kiefer reviewed the implementation and revision of Taiwan’s chemical management scheme under TCSCA/OSHA, followed by an introduction to the registration of Priority Existing Chemicals (PETs). Finally, he introduced the draft version of TCSCA which was issued in April 2017.

Throughout the event, REACH24H experienced consultants also met with partners, attendees and fellow professionals to exchange views and answer questions on the latest developments in the industry.

Robert Kiefer’s experience spans over twenty years in Washington, DC working for two major trade associations in the chemical and formulated products industries. Prior to REACH24H, Robert served as Director of Regulatory and Technical Affairs for the American Chemistry Council (ACC), and prior to that, Director of Scientific and International Affairs for the Consumer Specialty Products Association (CSPA). He has extensive regulatory advocacy experience in domestic and global chemical control regulations, trade policy, hazard communication, consumer products and pesticides. He joined REACH24H in 2014 as manager of the REACH24H USA Office.

Implementation of GHS in the AP region

In the session of Practical implementation of GHS, Mr. Robert Kiefer compared and contrasted the GHS regulations of different regions such as China, Taiwan region, Japan, South Korea, Thailand, Philippines, Singapore, Malaysia, Indonesia, Australia, New Zealand etc. Mr. Kiefer highlighted three major difficulties for GHS compliance in the AP region: firstly, professionals should be aware of the differences between the regulations in different regions. Secondly, the updates and changes of the regulations should be tracked, which can be difficult due to language barriers. Thirdly, even in the same country, there are discrepancies between different Authorities. At the end of this presentation, Mr. Kiefer suggested that when enterprises deal with GHS compliance, it is important for them to collect regulatory information in relevant Asian countries and keep track of updates of all relevant regulatory requirements. For enterprises developing chemical products, they must ensure they have the right hazard classification and hazardous data, and that they make the preparation of standard SDS and label their first priority. For employees, enterprises should carry out safety training exercises regularly to thoroughly explain chemical hazards and how to handle them in the case of an emergency.

The regulation framework of the chemical industry in China

Chemical management in China is a complex issue which involves many regulations and levels of authorities. Mr. Robert Kiefer gave a speech on Chemical Control Legislation in China and Japan. After introducing the complex regulatory system, he further analyzed the latest updates of regulations on chemical management in China, as well as environmental protection policies.

The increasingly stringent chemical regulatory system and regulatory requirements of various countries around the world have raised the barriers for international market access and played an increasingly important role in global trade-related chemicals compliance. Over the years, REACH24H has actively established a multi-party communication platform to promote the sharing of compliance information, sound management of chemicals throughout the life cycle and international cooperation in chemicals management so as to jointly promote a green and sustainable chemicals industry.

Hangzhou, Zhejiang- On November 1-2, 2017, over 200 global and Chinese government officials, regulatory specialists and enterprise representatives gathered at Marriott Hotel for the 9th Chemical Regulatory Annual Conference (CRAC) in Qianijang, Hangzhou.

As one of the most prestigious information technology summit in the industry, CRAC provides an unparalleled platform for government and enterprises to exchange the latest regulatory information, the most practical compliance experience and explores the future development of the industry.

With the rapid development of pesticide industry, increasingly stringent regulation has been implemented worldwide. In 2017, CRAC organized the Global Pesticide Registration Session to propel the sustainable growth of pesticide industry. From the vice Chairman of China Crop Protection Industry Association to the vice President of Shenyang Research Institute of Chemical Industry, from the division heads of China Institute for the Control of Agrochemicals, Ministry of Agriculture (ICAMA) to evaluation expert of UK Health and Safety Executive (HSE) and senior experts from Brazil, Argentina, Myanmar and Thailand delivered the latest regulatory information, interpreted the compliance strategies and exchanged the opinions about the trends of future development.

Highlights of CRAC 2017 included:

Mr. Tiechun Chen, chief of product quality review division of ICAMA concluded 11 major changes brought by China’s new pesticide regulations: streamlined system, defined responsibility, product safety, cancellation of temporary registration, transferable data, decentralized production license, OEM manufacturing, newly required marketing license, crop injury appraisal, product recall and occupational prohibition;

Mr. Chuanjiang Tao, chief of toxicity review division of ICAMA affirmed that pesticide risk assessment report will be mandatorily required for pesticide registration and revealed that ICAMA has accelerated the preparation of supporting guidance documents and models. He also suggested that preliminary risk assessment should be conducted during product R&D phase as registration failures can be predicted at early stage;

Mr. Liguo Xing form Shenyang Research Institute of Chemical Industry analyzed the impacted of the new regulation from R&D perspective. He commented that the new regulation requires more studies and more stringent safety evaluation, which will inevitably increase R&D costs and registration difficulty. He warned that pesticides in EU’s list of candidate for substitution are more likely to be included into China’s periodic registration reevaluation;
