ECHA to Decide on OR Authorisation under REACH

EU Commission appears to reach on the agreement in favour of permitting OR application for REACH authorisation

13 January, 2012

The European Commission has recently communicated to ECHA its preliminary agreement on allowing Only Representatives (Ors) to apply for and obtain REACH authorisation. The decision was made following an inter-services consultation between Directorates.

ECHA replies it still need some time to analyse the implications of a favourable decision on potential applicants and its feasibility in practice. If confirmed, the agency will prepare an official statement on its website.

The decision to permit ORs to apply for, and obtain, an authorisation would give non-EU manufacturers and suppliers of restricted substances the opportunity to remain on the market, in line with those of EU-based companies. It also has implications for EU downstream users operating under an OR, who may not have the resources or information required to apply for authorisation themselves.
