The REACH Regulation was put in place to integrate over 40 pieces of chemical legislations that applied to chemical substances. However, it does not replace certain existing pieces of legislation that apply in specific area’s e.g medicines, biocides, pesticides, cosmetics or radioactive substances.
It is important to check whether any substances, preparations or articles that you may manufacture/import into the EU are exempt under the regulation. Either full or partial exemptions may apply.
In accordance with Article 2 (1), (2) & (3) of the Regulation, the following are completely exempt from REACH:
- Radioactive substances
- Substances under customs supervision;
- Non isolated intermediates
- Dangerous transported substance(s)
- Waste
- Substances used in the interest of defence and covered by National exemptions;
Substances Exempted from Registration
- Medicinal products (human, veterinary);
- Substances used in food or feeding stuffs;
- Substances which occur in nature, if they are not chemically modified.
- Substances occurring in nature other than those listed under paragraph 7, if they are not chemically modified, unless they meet the criteria for classification as dangerous according to Directive 67/548/EEC.
- Polymers;
- Recycled or recovered substance already registered;
- Re-imported substance;
- Substances used for the purposes of product and process oriented research and development (PPORD).
- Substances included in Annex IV of the REACH Regulation
- Substances covered by Annex V of the REACH Regulation
Substances that have legislation previously in place and are considered as registered under the REACH regulation are:
- Notified substances according to Directive 67/548/EEC (Dangerous substances directive)
- Active substances for use in biocides;
- Active substances for use in plant protection products;
Substance with Specific Provisions
In accordance with Article 2 (8) of the Regulation, the following substances have tailored criteria for registration:
- Isolated intermediates (transported and on-site; Article 17, 18, & 19)
- Substances used for research and development e.g. product and process orientated research and development (PPORD; Article 9).
